Will the Trump Gold Card replace EB-5?
I'm sure you've heard about President Trump's announcement of the $5 million Gold Card, claiming it will offer green card privileges and a path to citizenship for wealthy people.
He mentioned it will be rolled out in two weeks. So my guess is it will be done through an executive order, much like DACA and TPS.
During the announcement, the Secretary of Commerce stated that the EB-5 program would be replaced with the Gold Card.
However, here’s the reality: the President cannot unilaterally end EB-5—it would require an act of Congress.
The current EB-5 law is valid until September 2027, and grandfathering provisions remain valid through September 2026. This means that if you file your EB-5 I-526E petition before the end of September 2026, your case will be processed, even if the program ends in 2027.
So for now, nothing has changed. But since Congress could choose not to renew EB-5 after 2027, it might be a good time to apply.
