Louisiana HB 431: Why Proving "Less Than 51% Fault" is the New Priority
As of January 1, 2026, Louisiana has transitioned to a 51% Modified Comparative Fault system under HB 431 (Act 15 of 2025). This landmark change to La. Civ. Code Art. 2323 means that if you are found to be 51% or more at fault for an accident, you are legally barred from recovering any compensation. Proving that your liability is 50% or less is now the most critical factor in securing a settlement for New Orleans wrecks.
