Legal tip to all my FB friends with homeowner’s insurance and a mortgage :
Beware of the “lender placed policy”. Many homeowners who allow their mortgage company to purchase a homeowner’s insurance policy for them and escrow it don’t realize that when their mortgage company purchases the policy -the homeowner is often not listed on the policy as the “named insured”, (only the bank is listed as the “named insured”.)
Depending on the policy language this can cause a lot of headaches for homeowners. Following a natural disaster, the homeowner files a claim with their insurance company only to realize that the insurance company denies the claim stating that they don’t have the ability to bring a claim since they are not the named insured. Sometimes these policies attempt to limit the coverage to the amount owed to the bank (“the named insured”) and oftentimes the bank has no interest in pursuing a claim as it’s not worth their time.
While it seems to be a case by case issue and dependent on the language in the policy, some Courts in Louisiana have ruled against the homeowners in these cases.
So out of an abundance of caution, if you do currently have homeowner’s insurance that was obtained by your mortgage company, get a copy of that policy and make sure you are named as an insured. If you are not, call the insurance company or broker right away and have that amended or obtain a new policy.
I have seen insurance companies try to take advantage of homeowners on a mere technicality when these homeowners have paid premiums for years.
Please spread the word to your friends and family members who may have “lender placed polices.”

Congratulations to my little sister, Maryclaire Manard, whose dog, Mookie, made it to the cover of Louisiana Advocates this month with this awesome picture she took. I’m a little jealous as I’ve never made it to the cover of Louisiana Advocates and Mookie didn’t even take the bar exam 😆. I’m thinking of now changing my law firm name to Manard, Manard and Mookie. Way to go, MC!
