A trust isn't the only way to keep assets out of probate.

Some assets already have their own instructions for what happens when you die. That can include jointly owned property and accounts with a named beneficiary.

And here is the part worth checking: those designations need to line up with the rest of your plan. An outdated beneficiary designation can tell a very different story from the one you intended.πŸ‘€

A trust can be beautifully drafted and still leave a gap.

If a house or bank account was never properly transferred into the trust, that asset may not be controlled by the trust at all. It could end up going through probate.

That is why creating the trust is only part of the process. The assets have to be properly connected to it, too.πŸ‘πŸ“„

This is where things can get complicated.

One sibling remembers Mom saying the house was theirs. Another remembers a completely different conversation. Someone else may have understood that the house would be sold and the proceeds divided.

Everyone may genuinely believe they are right.

The problem is, once a loved one is gone, they are no longer here to clarify what they meant.

Verbal promises can be remembered differently. Written instructions leave less room for interpretation.

Because "Mom always said..." can mean very different things when everyone remembers it differently.

If your wishes matter to you, make sure they are clearly documented so your family isn't left trying to figure out what you meant after you're gone.
