What is a Summary Consent Decree?

If you and your spouse are seeking a divorce or legal separation and have already reached full agreements, you may be able to file a summary consent petition and response. A summary petition and response is to be filed with two copies of the preliminary injunction, and the summary consent decree itself. Despite filing the documents at once, the court may not enter orders until at least 60 days have passed from the date of filing.

The summary consent petition and response is a single document that you must file with the court. This document should include general information about the parties, the date and location of marriage, and information about any minor children that the parties have in common. The document should also state why the court has jurisdiction, that formal service has been waived, that the marriage is irretrievably broken and/or the parties desire to live apart, and that you have reached full agreements. Finally, it should specify the orders that you want granted and be signed by both parties.

In Arizona, the court will charge you with a DUI offense for operating or being in physical control of a vehicle in any public place with a blood alcohol concentration (BAC) of 0.08% or more. Your BAC should be less than 0.04% if driving a commercial vehicle. Arizona also has a zero-tolerance DUI policy for underage drivers.

Can I get the other party to pay my attorney fees?

In some family law cases, a judge may award attorney fees to a party under A.R.S. §25-324. This means that the judge can order that one party pay another a specified amount of money after considering the financial situations of both parties and the unreasonableness of the party asked to pay the fees. If a party requests attorney fees, the judge will consider all the facts presented. Specifically, a judge must order attorney fees if any of the following is true:

1. If the petition was filed in bad faith
2. If the petition is not grounded in fact or based on law
3. If the petition was filed to harass the other party, to delay litigation, or to increase the expenses incurred by the other party

The judge may also award attorney fees based on additional factors, such as if a party unreasonably denies parenting time or knowingly disobeys a court order. Attorney fees are generally considered at or near the end of a family law case. The amount awarded may vary depending on the factors specific to your case, but it is not based on the outcome of the case (i.e. who “wins” or “loses” the case).
