FORMAL FINDING OF ACTUAL INNOCENCE & POTENTIAL COMPENSATION AWARD

After 23 years of wrongful incarceration, justice has finally spoken clearly and unequivocally for my client, Jeffrey Abramowski.

I am honored to share that Judge Lisa Shearer Nelson of the Florida Division of Administrative Hearings has issued a formal finding of ACTUAL INNOCENCE for Mr. Abramowski following a fully contested evidentiary hearing in which I presented compelling evidence supporting his innocence. This is not merely an exoneration. It is a judicial determination that Mr. Abramowski did not commit the crime.

As a result of my Motion to Vacate Mr. Abramowski’s Conviction, in April 2025, Mr. Abramowski’s murder conviction and sentence were vacated, and in July 2025 the State formally dismissed all charges with prejudice, forever barring reprosecution.

Actual innocence findings are rare. They require rigorous proof, exhaustive litigation, and the courage of the courts to confront past injustice head-on. This ruling stands as a powerful acknowledgment of the truth and the profound human cost of wrongful convictions.

Mr. Abramowski lost 23 years of his life, but today, the record finally reflects what should have been recognized decades ago: He is INNOCENT of the charges in which a quarter century of his life was stolen from him.

Judge Nelson’s finding paves the way for a significant compensation award for the 23 years of injustice that Mr. Abramowski endured, which we believe will be awarded at approximately $1,748,000.

EXONERATED!!!!!!

Vacating the murder conviction and life sentence of my wrongfully convicted client in April was such an amazing feeling and accomplishment. But that pales in comparison with the final dismissal of his charges this afternoon. Fully exonerated.

Today is a great day for justice for Mr. Abramowski and his family. They have waited for this day for well over two decades, and the sense of relief must be overwhelming at this time. Mr. Abramowski and I would like to thank and commend State Attorney Scheiner and his office, as well as the Brevard County Sheriff’s Office, the Brevard County Clerk of Court’s Office, and the Brevard County judiciary in our pursuit of justice. The integrity, competency, and hard work of all these entities is refreshing and a testament to the professionalism of the legal community in Brevard County. Although we are ecstatic and relieved that Mr. Abramowski has finally achieved his long-awaited justice, we pray and hope that the victim and his family eventually achieve their justice as well.

Amazing article about my innocent client’s first taste of freedom after 23 years of imprisonment for a bogus murder conviction. Freeing this innocent man from the longterm nightmare that he, his family, and the victim’s family endured is the absolute pinnacle of my professional career. I could not have accomplished this grand achievement without the support, encouragement, and perseverance of my late father and law partner, Edmund McCann, Jeff’s daughter, Jamie LeBlanc, Florida Today’s investigative reporter, John Torres, my friends at the Innocence Project, Seth Miller and Brandon Scheck, and many others. I commend and appreciate the support, integrity, and partnership of the Brevard County State Attorney’s office, especially former State Attorney Phil Archer and current State Attorney Will Scheiner, two great men with the highest levels of integrity and competency. I hope and pray that Jeff’s emotional and mental freedom will one day match his now physical freedom.

Justice served!!! McCann Law represented a Homeowners Association (HOA) who sued the beneficiaries of the developer of the association for ownership of the common area elements of the association. When the developer passed away, the beneficiaries shamelessly attempted to acquire ownership of the HOA’s common area elements through probate since the original deed of the property inadvertently remained in the personal name of the developer and not the HOA. Through creative and complex legal argument, Attorney McCann successfully blocked the probate matter and achieved judgment for title of the common area property in favor of the HOA client.
