It is not unusual for contractors to discover additional damage after storm repairs begin. What matters is how those changes are handled.

Under Indiana’s Home Improvement Contracts Act (HICA), 𝗰𝗵𝗮𝗻𝗴𝗲𝘀 𝘁𝗼 𝗮 𝗵𝗼𝗺𝗲-𝗶𝗺𝗽𝗿𝗼𝘃𝗲𝗺𝗲𝗻𝘁 𝗰𝗼𝗻𝘁𝗿𝗮𝗰𝘁 𝗴𝗲𝗻𝗲𝗿𝗮𝗹𝗹𝘆 𝗺𝘂𝘀𝘁 𝗯𝗲 𝗶𝗻 𝘄𝗿𝗶𝘁𝗶𝗻𝗴 and signed by the homeowner to be enforceable against the homeowner.

Before authorizing additional work:
✅ Get a written change order
✅ Make sure it describes the additional work being performed
✅ Make sure the additional cost is clearly stated
✅ Ask whether the change will affect the completion date
✅ Keep a signed copy with your original contract

🚩 Do not rely on “we’ll figure it out at the end.” An unexpected repair should not become an unexpected bill.

Homeowners dealing with storm damage may feel pressured to sign a contract quickly, but Indiana’s Home Improvement Contracts Act (HICA) provides important cancellation rights.

𝗙𝗼𝗿 𝗰𝗼𝘃𝗲𝗿𝗲𝗱 𝗵𝗼𝗺𝗲-𝗶𝗺𝗽𝗿𝗼𝘃𝗲𝗺𝗲𝗻𝘁 𝗰𝗼𝗻𝘁𝗿𝗮𝗰𝘁𝘀, 𝗮 𝗵𝗼𝗺𝗲𝗼𝘄𝗻𝗲𝗿 𝗴𝗲𝗻𝗲𝗿𝗮𝗹𝗹𝘆 𝗵𝗮𝘀 𝘂𝗻𝘁𝗶𝗹 𝗺𝗶𝗱𝗻𝗶𝗴𝗵𝘁 𝗼𝗳 𝘁𝗵𝗲 𝘁𝗵𝗶𝗿𝗱 𝗯𝘂𝘀𝗶𝗻𝗲𝘀𝘀 𝗱𝗮𝘆 𝘁𝗼 𝗰𝗮𝗻𝗰𝗲𝗹 𝘁𝗵𝗲 𝗰𝗼𝗻𝘁𝗿𝗮𝗰𝘁.

There is also an important additional protection when insurance coverage is involved. Under certain circumstances, the cancellation period does not begin until the homeowner receives the insurance company’s written final determination concerning coverage for the improvements.

If you recently signed a storm-repair contract:
✅ Read the contract and cancellation notice carefully
✅ Pay attention to the date and method for cancellation
✅ Keep a copy of everything you signed
✅ Keep your insurance company’s written coverage determination
✅ If you decide to cancel, do it in writing and keep proof that it was sent

With so many contractors coming into Northwest Indiana following the recent storms, homeowners should not simply take a contractor’s word that they are “licensed and insured.”

Before allowing someone to work on your home:

✅ Call your city or town hall. Ask for the Building Department, Planning Department, or contractor licensing office and ask whether the contractor is currently licensed or registered to perform the type of work being proposed in your community. ✅ Verify insurance independently. Ask for a current certificate of insurance showing liability coverage and, when applicable, workers’ compensation coverage. Call the insurance agent or carrier listed on the certificate and confirm that the policy is current.
✅ Make sure the names match. The company name on the contract should match the contractor you researched and the business identified on the insurance documentation.

🚩 Do not rely solely on a business card, yard sign, professional-looking truck, website, or a piece of paper saying the contractor is “licensed and insured.” 𝐕𝐞𝐫𝐢𝐟𝐲 𝐢𝐭 𝐲𝐨𝐮𝐫𝐬𝐞𝐥𝐟.

📋 A simple timeline of important conversations, inspections, payments, and repairs

Do not rely on your contractor, insurance company, or adjuster to maintain these records for you. Keep your own copies.

With contractors flooding into Northwest Indiana following the recent storms, homeowners should know that Indiana’s Home Improvement Contracts Act (HICA) provides important protections when hiring someone to repair your home.

Under HICA, most 𝗵𝗼𝗺𝗲 𝗶𝗺𝗽𝗿𝗼𝘃𝗲𝗺𝗲𝗻𝘁 𝗰𝗼𝗻𝘁𝗿𝗮𝗰𝘁𝘀 𝗼𝘃𝗲𝗿 $𝟭𝟱𝟬 𝗺𝘂𝘀𝘁 𝗯𝗲 𝗶𝗻 𝘄𝗿𝗶𝘁𝗶𝗻𝗴 and include important information such as:
• A reasonably detailed description of the work
• Approximate start and completion dates
• The total contract price
• The contractor’s name, address, and contact information
• Disclosure regarding subcontractors or third parties performing the work

Be especially cautious of contractors who:
🚩 Pressure you to sign immediately
🚩 Make promises that are not included in the written contract
🚩 Offer to waive, pay, rebate, or otherwise offset your insurance deductible
🚩 Tell you they will “handle everything” with your insurance company
🚩 Ask for large upfront payments

Changes to the project generally must also be in writing and signed by the homeowner. HICA also provides consumers with a three-business-day right to cancel, and additional time may apply when insurance coverage is involved.

Importantly, a contractor who violates HICA commits a deceptive act under Indiana law and may be subject to the remedies and penalties available under Indiana’s Deceptive Consumer Sales Act.

Take your time, verify the contractor, get everything in writing, and read the entire contract before you sign.

The recent severe storms have caused significant property damage throughout our area. If your home or business sustained damage, there are a few important steps you should take:

• 𝗗𝗼𝗰𝘂𝗺𝗲𝗻𝘁 𝗲𝘃𝗲𝗿𝘆𝘁𝗵𝗶𝗻𝗴. Take photographs and videos of all damage before beginning cleanup or repairs.
• 𝗣𝗿𝗲𝘃𝗲𝗻𝘁 𝗮𝗱𝗱𝗶𝘁𝗶𝗼𝗻𝗮𝗹 𝗱𝗮𝗺𝗮𝗴𝗲. Take reasonable steps to protect your property from further loss, such as covering damaged roofs or removing standing water, but do not put yourself in danger.

• 𝗕𝗲 𝗰𝗮𝘂𝘁𝗶𝗼𝘂𝘀 𝘄𝗶𝘁𝗵 𝗰𝗼𝗻𝘁𝗿𝗮𝗰𝘁𝗼𝗿𝘀. Before signing a contract or paying a substantial deposit, verify the contractor's credentials and carefully review the agreement.

Most importantly, stay safe. Property can be repaired and replaced.
