Specifically, the suspension does not affect:

* People in valid status in the United States and have applied, or will apply, for adjustment of status.
* Non-immigrant visas, including F-1 student, J-student visas, and all work visas (E, H-1B, O-1, etc.), tourist visas, and student visas.
* Immigrant visa (“green card”) processing— including F-1 student visas, J-1 training visas, Tourist visas, and all work visas (E, H-1B, O-1, etc.)
* Dual nationals applying with a valid passport from a country that is not listed above are exempt from this pause.

Considering these new policies, file now NOT later! It’s also important to have a pending application to stay protected from the onlgoing policy changes and ICE.

Immigrant visa processing for citizens of 75 countries will be paused starting Jan 21, 2026, as part of a new public-assistance policy. Immigrant visas processed at U.S. consulates abroad will be on hold while the government reassesses who may become dependent on public benefits-this is the stated purpose.

This suspension does not affect the following:

* People in valid status in the United States and have applied, or will apply, for adjustment of status.

* Non-immigrant visas, including F-1 student, J-student visas, and all work visas (E, H-1B, O-1, etc.), tourist visas, and student visas.

Remember, these are generally to keep you safe—We have heard of instances where ICE did not stick to the law when doing arrests. Your part is just to be vigilant.

Please note, having a prior order of removal or one that was administratively closed (not fully closed)may give the govt the the ability to reopen your case in immigration court or in some cases, detain you.
