If your client has a car accident and they have their car fixed prior to filing suit for the accident, have they committed spoliation?

Here's a taste of the CLE that I taught with Judge Ron Hedges entitled "Litigating with Electronic Information in Civil Cases (Part 2)" where we discuss this issue. Here I discuss spoliation and the scienter/mental state requirements before a court may find spoliation and award sanctions. I just have to share this article which shows some of the issues surrounding our legal system in Tennessee and navigating it from a lay person's perspective. You simply cannot get enough information about the legal system watching an episode of the latest legal show. Yet many try to do it. But, ask yourself, would you know that a "Detainer Warrant" did not mean that you were going to be arrested but meant that you were being evicted? See the article here:
