A Power of Attorney (POA) is a legal document that allows you (the ā€œprincipalā€) to appoint another person (the ā€œagentā€ or ā€œattorney-in-factā€) to make decisions and act on your behalf.

This authority can cover financial, legal, or healthcare matters, depending on the type of POA you create. It is commonly used to ensure that someone you trust can manage your affairs if you become unavailable or unable to make decisions yourself.

There are different types of Power of Attorney, including:
1ļøāƒ£General POA – gives broad authority over your affairs
2ļøāƒ£Limited POA – grants authority for specific tasks or a set period
3ļøāƒ£Durable POA – remains effective even if you become incapacitated
4ļøāƒ£Healthcare POA – allows someone to make medical decisions for you

In short, a Power of Attorney helps ensure your affairs are handled according to your wishes when you cannot act on your own.

"All things, Life & Legacy" - Bostick Law

šŸ‘©ā€āš–ļø The most common issue when probating wills is that the will has not been prepared properly or was not executed properly or accordingly to the laws of your State.

This similar issue exist if you have your will prepared in one state and later move to another state. States have different laws concerning wills and other estate planning documents. If you no longer live in the state where your will,or any other estate planning document, was prepared, you should update these documents as soon as possible.

Why is this important? If your will is not able to be admitted for probate, your estate will be distributed according to the laws of the state, which means that your estate may not be distributed as you desire.

One of the most essential tools in estate planning is a Financial Power of Attorney.

Before having one prepared, it’s crucial to fully understand how it works, the authority it grants, and the options available—so you can make informed decisions that truly protect your interests and your loved ones.

1 out of every 3 probate clients I represent experiences family conflict after the loss of a loved one—often more than one issue.
The good news? Many of these disputes can be avoided with thoughtful planning:

āœ”ļø Proper estate planning
Have the right documents in place—Wills, Powers of Attorney, Living Wills, and Trusts.

āœ”ļø Keep your plan up to date
Review and update your estate plan every 3 years, or after major life events, purchases, or business changes. Regular updates show clear intent and help ensure nothing is overlooked.

āœ”ļø Communicate your wishes
Talk openly with family and trusted friends about your plans. Grief affects everyone differently, and clear communication can prevent confusion, resentment, and hurt feelings later on.

āœ”ļø Let trusted people know where your documents are
Make sure the right individuals know the location of your original estate planning documents—and provide them with copies.

āœ”ļø Store documents safely
Keep originals in a secure, protected place such as a fire- and water-proof box or safe. Lost or destroyed documents can be impossible to replace.

Planning today protects the people you love tomorrow.

4 Essential Steps to Safeguard Your Digital Assets

Step 1:
Prepare comprehensive inventories of your digital assets and their access information. Passwords and account numbers should be maintained separately to minimize security risks.

Step 2:
Store these inventories in a secure location. Because they contain sensitive personal and financial data, improper access could result in identity theft or financial loss.

Step 3:
Designate a digital executor to implement your digital estate plan and ensure your instructions are carried out upon your death.

Step 4:
Document your instructions regarding the disposition of your digital assets. Although traditional estate planning documents may address financial accounts, online access and management should also be clearly outlined.
