Mediation and arbitration are not the same thing, and the difference matters.

In mediation, a neutral third party helps both sides reach a voluntary agreement. Neither side is forced into a result.

In arbitration, a neutral third party hears the case and issues a binding decision. It functions similarly to a private trial, without the delays and formality of the court system.

Arbitration can be a powerful tool in family law cases where the parties cannot reach agreement through negotiation but want to avoid a full public trial. It is faster, more private, and puts control of the timeline in the hands of the parties rather than the court's docket.

Myth: Filing for divorce first gives you an advantage.
Fact: Who files first rarely changes the outcome.

Tennessee is a no-fault divorce state, and courts generally do not view the petitioner differently than the respondent when making decisions about property, custody, or support.

There are limited circumstances where timing can matter, primarily when there are concerns about asset protection or jurisdiction. But the idea that filing first automatically puts you in a stronger position is largely a myth.

What matters far more than who files is how well-prepared you are. That is where the real advantage lies.

Chelsea Connor did not just study the law.

Before joining Gill Family Law, Chelsea earned her Bachelor of Accountancy from Mississippi State, graduated magna cm laude from Mississippi College School of Law, and clerked for the Honorable Jim Kyle in Shelby County Chancery Court. That clerkship gave her a rare view of the court system from both sides of the bar.

Outside the office, Chelsea chairs the West Cancer Foundation Young Professionals Advisory Board, serves on the Executive Board of the Association for Women Attorneys, and is a board member for the Dream Factory of Memphis.

Fact: Courts cannot enforce what is not in writing.

Co-parenting arrangements made informally through a text, a conversation, a handshake often fall apart the moment one party changes their mind. Without a court-approved written order, there is no legal mechanism to enforce the agreement.
