Driving Apps and DUI

Apps such as Google Maps, Apple Maps and Waze can tell drivers when they are approaching speed cameras or random breath testing stations. Countries such as Germany, France and Switzerland have banned apps from displaying these enforcement locations.

Alcohol Absorbtion and DUI Breath Test Cases.

It is important to ask a client about health issues when defending DUI cases with a beath test. Alcohol absorbtion and any delay in processing alcohol in the system can result in breath test above the legal limit due to a health condition.

It is useful in certain alcohol cases to show that some medical conditions can lead to delayed gastric emptying, meaning the person may still be absorbing alcohol (think GERD, retrograde extrapolation).

"Studies have shown gastric emptying is likely to be altered in people suffering from diabetes mellitus, GERD, hyper- thyroidism and anorexia nervosa and in those taking certain medications."
