🏍️🚗 🏍️🚗 Motorcycle Accident Myth: If a motorcycle broadsides a car, the rider is not automatically at fault

With warmer weather upon us and more motorcycles back on the road, crashes involving motorcycles are increasing—and one of the most serious crash scenarios we see here in Delaware, Chester, and Montgomery Counties involves a motorcycle broadsiding another vehicle, often at busy intersections or during left‑turn situations.

At first glance, many people assume the motorcyclist is automatically at fault. In reality, that’s often not true.

Common situations we see locally include:

• A driver turning left without yielding to an oncoming motorcycle
• A car pulling out from a side road or driveway and misjudging speed or distance
• A driver running a red light or stopping suddenly in an intersection
• Distracted or inattentive driving in high‑traffic areas
ttentive driving in high‑traffic areas

When a motorcycle broadsides a car, the rider almost always suffers the most severe injuries—simply because they have far less protection.

⚠️ Fault depends on the facts, including:

• Who had the right of way
• Traffic signals and signage
• Speed and visibility
• Driver distraction
• Road and weather conditions

These cases require careful investigation—not assumptions based on appearances.

If you or a loved one has been injured in a motorcycle accident in Delaware, Chester, or Montgomery County—even if it seems like the motorcycle “hit” the car—it’s worth getting the facts reviewed. You may have options you’re not aware of.
If you have questions after a crash, experienced local guidance can make all the difference.

Stay safe out there. 🏍️🚘

On April 8, a parking garage under construction in Philadelphia collapsed, resulting in the tragic loss of three construction workers. This incident has sparked questions from my non-lawyer friends about the legal response and the parties involved in potential litigation.

The question of who is ultimately responsible is complex and requires careful consideration. Determining fault and ensuring fair compensation for the families involved will take time and effort.

While it might seem logical to hold the employer accountable, Pennsylvania’s Workers’ Compensation Act generally limits the employer’s liability to workers’ compensation benefits, even in cases of death. In fact, the employer can even assert a subrogation lien against any recovery from a third party.

The primary parties responsible in such cases are typically third parties, including general contractors, construction managers, subcontractors, property owners, developers, equipment manufacturers, rental companies, design professionals, and materials suppliers, and others. This intricate web of relationships makes it challenging to pinpoint the exact cause of the accident.

Pennsylvania law allows for fault to be apportioned among all individuals whose negligence contributed to the death, even if some parties are immune or not named as defendants. This complexity necessitates a thorough investigation and analysis of the contracting and subcontracting processes.

To navigate this intricate web, legal professionals employ early expert analysis, cutting-edge AI technology, and aggressive negotiation strategies to secure the best possible outcome for the families involved.

Victory in PFA Court

Today, I successfully represented a client in a Protection From Abuse matter. By focusing on the evidence and the legal standards set forth in the statute, the Court found that the allegations did not meet the definition of abuse under the law.

The outcome was significant. Decisions in these cases can have lasting consequences on employment, parental rights, and financial stability. I’m grateful that the Court carefully weighed the facts and applied the law as intended.

Family law matters are never easy—emotions run high, and stakes are real. That’s why I remain committed to providing steady, thoughtful advocacy and achieving the best possible outcomes for my clients.

What Is Disc Desiccation—and Why Does It Matter After a Car Accident?

After a motor vehicle accident, it’s common for people to hear unfamiliar medical terms in their MRI reports. One of those terms is disc desiccation.

Disc desiccation refers to loss of hydration in the spinal discs, which act as cushions between the vertebrae in your neck and back. Healthy discs are flexible and well hydrated. When a disc becomes desiccated, it can lose height and elasticity, potentially contributing to pain, stiffness, reduced mobility, or nerve symptoms.

Insurance companies often argue that disc desiccation is simply a “degenerative” or age related condition. What they don’t always acknowledge is that a motor vehicle accident can aggravate, accelerate, or make a previously asymptomatic condition painful and disabling.

Why this matters in an injury case:

MRI findings like disc desiccation must be viewed in context, not in isolation. Symptoms that begin or worsen after an accident are legally significant. Pennsylvania law recognizes injuries that aggravate pre-existing conditions. Proper medical documentation and legal presentation can make a critical difference.

If you’ve been told your symptoms are “just degeneration,” it’s important to understand that the timing, severity, and impact of your symptoms matter—not just what appears on an imaging report. Disc desiccation does not automatically mean your pain isn’t accident related, and it should never be dismissed without proper medical and legal review.

If you were injured in a motor vehicle accident and have questions about MRI findings, disc injuries, or how insurance companies evaluate these claims, don’t wait to get answers. Speaking with an attorney early can help ensure your injury is properly documented and fairly evaluated.

🚨 Injured in an Accident? Here’s Why You Should Contact a Lawyer ASAP 🚨

When you’ve been hurt in an accident, life gets overwhelming fast — medical appointments, insurance calls, missed work, and stress. But one of the most important steps you can take is reaching out to an experienced personal injury lawyer as quickly as possible.

Here’s why timing matters:

✅ Evidence Can Disappear Quickly:
Video footage gets erased, vehicles get repaired, and witnesses’ memories fade. The sooner a lawyer is involved, the faster they can secure the evidence that strengthens your case.

✅ Insurance Companies Act Fast — So Should You:
Insurance adjusters often reach out quickly, hoping you’ll accept a low offer or make statements that can be used against you. Having a lawyer early helps protect your rights from day one.

✅ Deadlines Apply:
Pennsylvania has strict time limits for filing personal injury claims. Missing them can mean losing your right to compensation entirely.

✅ You Focus on Healing — We Handle the Rest:
From gathering records to negotiating with insurers, early legal help means less stress and more time for your recovery.
If you or someone you love was injured in Delaware County, don’t wait. A quick call today can make a major difference in your case tomorrow.

Why You Still Should Hire an Attorney for a “Simple” Uncontested Divorce in Pennsylvania - Brought to you by The Law Offices of Robert R. Hopkins, LLC

A lot of people in Pennsylvania think they can handle an uncontested divorce on their own because the forms are online and the process “looks simple.” And yes—you can do it yourself.
But here’s the honest truth:

Even the simplest uncontested divorce in PA can get complicated fast. One small mistake can delay everything or even cause long term problems.

Here’s why working with The Law Offices of Robert R. Hopkins, LLC is still the smart move:

🔹 1. PA courts hold you to the same standards as attorneys.
If you represent yourself, you must follow all statewide and county specific rules perfectly. There’s no flexibility for mistakes or misunderstandings.

🔹 2. The paperwork is precise and easy to mess up.
For a mutual consent divorce under 23 Pa.C.S. § 3301(c), you need the correct Complaint in Divorce, Affidavits of Consent, county specific forms, and a proper Praecipe to Transmit Record.
DIY filers frequently make timing, signature, and filing errors that delay their divorce.

🔹 3. Residency matters more than people realize.
PA requires at least one spouse to have lived in the state for six months before filing. People moving between counties—or in and out of PA—often stumble over this requirement.

🔹 4. The 90 day waiting period must be done exactly right.
PA’s mutual consent divorce includes a mandatory 90 day waiting period, but it only starts after the other spouse is properly served. Incorrect service = delayed divorce.

🔹 5. A lawyer protects you from long term mistakes.
Even if everyone gets along, people often mis-handle:
• Retirement division
• Tax impacts
• Custody and parenting time considerations
• Enforceability of settlement agreements
These issues can affect your family and financial future for years.

🔹 6. Every PA county has different rules.
Pennsylvania has 67 counties, each with its own filing fees, forms, and local procedures. An attorney already knows the local process—saving you time, money, and stress.

Bottom Line
A Pennsylvania uncontested divorce can be simple…
But only if the legal work is done correctly.
Hiring an attorney means your divorce is handled accurately, efficiently, and permanently, the first time.

At our firm, we recognize that celebrating Black History Month is essential to honoring the profound impact Black Americans have had on our legal system, our communities, and our nation’s ongoing pursuit of justice. The month offers an opportunity to reflect on the courage and contributions of trailblazers who challenged discriminatory laws, expanded civil liberties, and reshaped the meaning of equality under the Constitution. Their achievements—often made in the face of extraordinary barriers—continue to influence the work we do each day.

Black History Month also reminds us of the importance of understanding the historical context behind many of the legal issues we navigate today. From landmark civil rights cases to the evolution of voting rights, housing protections, and workplace equity, the legal profession is deeply intertwined with the fight for racial justice. Acknowledging this history strengthens our commitment to providing informed, empathetic, and equitable advocacy for every client who walks through our doors.

Finally, celebrating Black History Month aligns with our firm’s values of integrity, inclusion, and service. It encourages us to listen, learn, and engage more deeply with diverse perspectives—within our team and within our community. By elevating these stories and continuing this conversation, we not only honor past generations but also contribute to a legal landscape that is fairer, more accessible, and more just for all.
