Final Offer – the new way to solicit offers?

Technology is constantly evolving the way people do business, and a new platform is attempting to change how real estate is sold. Final Offer (https://www.finaloffer.com/) is a website that allows sellers to solicit offers from prospective buyers online. Sellers and Buyers must have a licensed real estate agent licensed in the jurisdiction where the property is located to use Final Offer. Sellers can include a “Minimum Committed Offer” and/or a “Final Offer” in the listing. The Final Offer is the offer a seller will accept immediately and the Minimum Committed Offer is the minimum price and base terms a seller will accept at the end of the “Offer Window”. During the Offer Window, prospective buyers can make competing offers. For more details see https://www.finaloffer.com/terms-of-use. According to its website, the goal of Final Offer is to provide a more transparent way of selling real estate. It appears that Final Offer is currently available in Massachusetts, D.C., Maryland, and Virginia.

Pick Me! Pick Me! (The issues with “Buyer Love Letters”)

In a competitive market, buyers often submit letters to help persuade sellers to accept their offer. Commonly referred to as “Buyer Love Letters”, these letters could mean trouble for sellers when choosing between multiple offers. The National Association of Realtors warns listing agents of the potential exposure to liability for seller clients under federal and possibly state fair housing laws. A letter may seem harmless, but the letter may contain content revealing a buyer’s race, religion, national origin, or other protected category under fair housing laws. NAR offers agents tips on how to avoid possible issues with “Buyer Love Letters” in a recently published article - How to How to Handle Buyer Love Letters (nar.realtor).

The Post Settlement Occupancy Agreement had significant modifications made to it in NVARs recent standard forms updates. Below are some changes worth noting.

1. Rent payment, PITI option removed.

2. Occupancy Deadline – clarifies that if Seller vacates early the Seller remains liable for utilities and the maintenance and condition of the property until the Deadline.

3. Security Deposit – if notice isn’t provided to the Seller and Escrow Agent as required, then the Escrow Agent must release the security deposit to the Seller.

4. Notices – the provision has been revised to remove the Brokerages from the post-settlement notice process – shifting the obligation to the Seller and Buyer.

5. Property Condition – incorporates the “as-is” provision of the Contingency Clause Addendum if applicable.

6. Risk of Loss – Seller must now maintain an insurance policy for Seller’s personal property. It is no longer optional.

7. Access – option included to negotiate access. Clarifies 24 hours' notice is reasonable notice.
