What are the Penalties in Virginia if a Person is Convicted of a DWI❓

Virginia has certain penalties that must be imposed if a person is convicted of a DWI offense. These include:

📍Mandatory minimum fine of $250 (§ 18.2-270)
📍 Suspension of privilege to drive in Virginai for at least 12 months (§ 18.2-271)
📍 Mandatory enrollment in Virginia's Alcohol Safety Action Program (§ 18.2-271.1)
📍Mandatory jail sentence in cases where the accused's BAC is proven to have been at least a .15 (§ 18.2-270)

After Closing Arguments, the judge typically makes a decision in a DWI case that same day. 👩‍⚖️

A judge will typically do one of three things: find the person Not Guilty, Guilty, or, in some circumstances, find the person Guilty of a lessor crime. If a person is found Guilty, sentencing usualy happens on that same day. At sentencing, the judge may consider factors such as if the person has a criminal record and any mitigating steps the person took before the trial date such as enrollment in treatment.
