BIG NEWS FOR APPLICANTS APPROVED FOR ASYLUM!!

USCIS has recently clarified that asylees who are approved for asylum DO NOT need to wait one year before filing their greencard application! The policy states that the individuals must have been physically present in the U.S. for one year WHILE the agency processes their Form I-485, Application to Register Permanent Residence or Adjust Status, rather than at the time they file their adjustment of status application. Since processing of the I-485 application is taking more than one year, asylees can apply for their greencards right away!

Attention: There is an IMPORTANT New Rule pertaining to International Students (F1 and M1 visa holders) that was released by ICE this week:

This New Rule changes the current ICE policy of allowing F1 students to take all classes online, due to the COVID-19 pandemic. For the Fall semester, students can only remain in the U.S. in F1 status if (1) they attend a school with hybrid (online and in person) instruction and attend some classes in person or hybrid, and the minimum allowed classes online, or (2) if they attend all classes in person, with the usual exception that they may take a maximum of one online course or three credit hours online.

Schools that will offer classes online-only in the Fall semester will not be able to keep F1 students in status (including both new and returning/ongoing F1s).

The CARES act, providing economic relief for those affected by the pandemic, was just signed into law by the President. One of the provisions of this act is a “Temporary Moratorium on Eviction Filings” (Sec 4024). This stipulates that a Tenant living in a “covered property” may not be evicted for non-payment, partial payment, or late payment of rents for a period of 120 days after the date the legislation was signed. Additionally, those Tenants may not be served Notice to Vacate for a period of 120 days after the date the legislation was signed.

We can guide you to check your records to determine if your property is a “covered property” so that we know how to legally handle any delinquent rent payments. The act describes a “covered property” as follows:

(2) COVERED PROPERTY—The term ‘‘covered property’’ means any property that:

(A) participates in:
(i) a covered housing program (as defined in section 41411(a) of the Violence Against Women Act of 1994 (34 U.S.C.12491(a))); or
(ii) the rural housing voucher program under section 542 of the Housing Act of 1949 (42 U.S.C. 1490r); or
(B) has a:
(i) Federally backed mortgage loan; or
(ii) Federally backed multifamily mortgage loan.

On February 24, 2020, USCIS began to implement the new "Public Charge" rule and is now applying it to certain new applications for green cards in the U.S., especially in family sponsorship cases. A similar rule applies to people applying for an immigrant visa overseas. The new rule makes it more difficult to get a green card for people who have received, or are likely to receive public benefits in the future.
