Trusts and Wills - Certain types of assets, such as those held in trusts and those with beneficiary designations, are not subject to the Illinois probate process. Placing certain assets, such as real estate, in a trust will help avoid the necessity of opening a probate case in court. Similarly, assets with beneficiary designations, such as a life insurance policy or 401(k), will be paid directly to whoever is designated as the beneficiary. However, for some clients for whom a trust may not be necessary it is beneficial to have a last will and testament prepared that name your desired legatees and any specific bequests. We can help you draft a new will or review and update an existing will, perhaps after a significant life change like a divorce or remarriage.
