How Does Shared Fault Work?
In New Jersey negligence cases responsibility can be shared between a cyclist and a driver. Joseph Ghabour explains that comparative negligence allows a jury to assign percentages of fault totaling 100 percent and the final compensation depends on those findings. If a cyclist is 50 percent or less at fault recovery is reduced but still possible and if above 50 percent recovery is barred.
