NOT GUILTY!
Attorney Jack VanBibber recently obtained another Not Guilty verdict following a two (2) day long jury trial in the Marion County Common Pleas Court in Case No.: 2022-CR-0144.
Our client was an inmate at the North Central Correctional Complex who was accused of aggravated possession of drugs following a report by a corrections officer that our client had possessed an address book, which was later found to be laced with synthetic ma*****na following testing of the same by the Ohio State Highway Patrol. The corrections officer reported that our client had the address book in question in his hand, which contained the synthetic ma*****na, and that our client attempted to conceal said address book when questioned about the same by the corrections officer.
The facts as alleged by the corrections officer and the Marion County Prosecutor’s Office presented another daunting task for the Defense, but attorney VanBibber argued that the defendant did not know the drugs were in the address book as they were placed there by the defendant’s cell mate without the defendant’s knowledge. Attorney VanBibber also fought vigorously to keep out an instruction to the jury which would have allowed the jury to consider that the defendant did not have to know what the underlying substance was, and following attorney VanBibber’s arguments the Court agreed to keep said instruction out of the instructions which were presented to the jury. Successfully arguing an essential element is a difficult task, but was successfully done by attorney VanBibber in this case.
