California Department of Social Services released a major proposal for new dementia care regulations in assisted living facilities (also known as RCFEs). The updated regulations would assure that every facility is dementia-care competent and would end a very problematic regulatory division between facilities that care for residents with dementia and those that donโ€™t. Comments are due October 24.

Federal Memo Restores Nursing Home Visits!

On Thursday, the Centers for Medicare and Medicaid Services (CMS) released a memo to the states, restoring visitation in nursing homes. CMS is requiring facilities to permit visitation whenever a facility has had no new COVID outbreaks for 14 days and the community positivity rate is less than 10%.

On August 25, the California Department of Public Health outlined some significant changes relating to visiting nursing homes during the COVID pandemic:
Visitors must be permitted for legal matters that cannot be postponed including, but not limited to, estate planning, advance health care directives, Power of Attorney, and transfer of property title.
