A common question we hear from clients is "Can I date during my divorce?" While in most cases, Judges don't care if you start dating someone new AFTER you separated from your spouse, there are a few key issues you should be aware of.
1) Wait a few months after you officially separate from your spouse before you start dating. Any earlier than that, and questions may arise about whether this new relationship actually started during your marriage and CAUSED your divorce.
2) If cheating was the cause of your divorce, it can prevent the cheater from receiving alimony and negatively affect the portion of marital property.
3) Last, be careful about introducing your new boyfriend or girlfriend to your kids. A good rule of thumb is waiting until you've been dating monogamously for about six months first. Ensuring the stability and wellbeing of your kids during divorce should be a top priority for you as a parent.
No one expects you to avoid dating for the entire duration of your divorce, but it can come with pitfalls. Be careful and keep your children's best interests in mind.
