We recently won an appeal out of Cherokee County on the issue of whether a separate search warrant is necessary to test a blood sample for drugs when the warrant application and original search warrant only mentioned suspicion of alcohol. You can read the opinion here:

We won a small victory in Cherokee County today. Our client was charged with DUI-Alcohol, DUI-Drugs, and DUI-Combined influence. Our client exercised his constitutional right to refuse chemical testing of his blood pursuant to the Georgia Implied Consent Statute, and the arresting officer obtained a search warrant for the client’s blood. The only crime alleged in the warrant was DUI-Alcohol, and accordingly, the GBI tested the blood sample for alcohol, yielding a blood alcohol content result under the per se limit of .08.

Seven weeks later, the GBI re-tested the blood for drugs and discovered a prescription medication in his blood, and the Cherokee County Solicitor’s office added the additional charges of DUI-Drugs and DUI-Combined Influence. We filed a motion to suppress the results of the second blood test because the test for drugs exceeded the scope of the warrant. The trial judge granted our motion, effectively dismissing the DUI-Drugs and DUI-Combined Influence charges. I’ve seen DUI charges for operating golf carts and lawn mowers, but this is the first time I’ve seen someone charged with DUI for an airplane making an emergency landing on a highway. In Georgia, DUI simply requires that a person be “in actual physical control of a moving vehicle“ while under the influence of alcohol to the extent that the person is a less safe driver. The pilot’s attorney is going to have to be creative to have a chance of winning this novel case.

A student pilot who landed a small plane on a Missouri highway early Friday was arrested on charges including driving while intoxicated, authorities said.

We have experience representing business owners accused of violating the Georgia Controlled Substances Act for selling h**p derived products. The Georgia H**p Farm Act legalized all extracts of the cannabis sativa plant as long as the plant has a naturally occurring delta 9 THC level under .3%. However, there are limitations. For example, it is not legal to possess the unprocessed flower of the h**p plant without a permit, and edibles made from extracts of the h**p plant must be USDA approved. Violating the Georgia Controlled Substances Act by possessing extracts of the cannabis plant that are not within the scope of the Georgia h**p farm act is a felony.
