In 2011, I began my journey to learn about dual citizenship with Italy. My journey culminated in August 2012 when I was finally recognized as an Italian citizen. Since then, I have worked with hundreds of clients to help them get closer to their dreams.

One of the most difficult conversations I have with people is after they attempted to file a New York petition on their own and their case was dismissed on procedural grounds.

Many individuals understandably believe that if their facts are strong, the court will simply “hear the case.”

They are surprised to learn that a strong case can still be dismissed because of procedural mistakes.

In New York, petitions involve far more than completing forms or explaining your situation.

Service requirements, timelines, verification rules, supporting evidence, and court procedure all matter.

Overlooking even one issue can create major setbacks. While courts have some leeway to overlook some mistakes, the courts generally cannot overlook procedural errors.

Unfortunately, many people do not realize this until after a dismissal occurs.

The legal system is much more procedural than people expect.

I have said it before and I will say it again.

REAL ID has become a real headache!

As REAL ID requirements continue to affect more people, one issue keeps surfacing repeatedly:

Many individuals cannot obtain certified copies of their New York birth certificates because the name on their current driver's license does not exactly match the name listed on their original birth record.

The inability to get your own certified birth certificate can be incredibly frustrating.

These situations are a reminder that documents shape access, recognition, and the freedom of movement.

Many families are anxiously awaiting the Italian Supreme Court’s decision following the April 14, 2026 hearing.

Over the past several weeks, I’ve spoken with clients experiencing a mix of hope, worry, and uncertainty. That reaction is completely understandable.

I have also been in contact with many Italian attorneys about the pending decision and even traveled to Sicily to meet with one of my colleagues.

I personally understand that for many people, these cases are about far more than a passport. I have been through the process myself.

What's even more confusing is how I am able to maintain my Italian citizenship but my twin brother struggles with whether he even has a path right now. The two situations are incongruent with each other.

For now, we wait for the decision.

And while waiting is difficult, this moment has revealed something important: how deeply people care about preserving and recognizing their family legacy.

⚖️ A common issue many families don’t anticipate in immigration-related cases: criminal background checks.

I work with spouses of foreign nationals who are surprised to learn that even older or seemingly minor criminal records can become relevant during immigration or citizenship-related processes.

Immigration-related applications are highly technical, and small procedural mistakes or omissions can unfortunately lead to delays that could have been avoided.

In many cases, early guidance makes a significant difference in how smoothly the process moves forward.

If you are navigating a situation involving background checks or prior records, it is important to understand the requirements before filing—not after.

🇮🇹 Is Italian citizenship being called a “birthright”? Here’s what is going on from last week's decision.

There has been a lot of discussion recently around Italian Supreme Court language describing jure sanguinis citizenship as an “original” or “absolute” right tied to birth and lineage.

Here’s what’s important to understand:

This is not a new rule or a final ruling changing the law.

Rather, it reflects an evolving line of legal reasoning in which courts increasingly describe citizenship by descent as a status that arises automatically at birth—based on bloodline continuity—and is later recognized by the State, not created by it.

At the same time, key issues such as the “minor rule” and generational limitations are still actively being litigated, and we are still awaiting important written decisions.

The takeaway:
The language is evolving, but the law is still being clarified.

As always, it’s essential to distinguish between legal commentary, judicial reasoning, and binding decisions.
