Three New Laws To Know Take Effect in New Hampshire on January 1, 2025

NH House Bill 398, Relative to Notice of PFAS Contamination Prior To The Sale of Real Property:The bill has implications for all real estate transactions. All New Hampshire sellers (or their agents) must notify prospective buyers about the potential presence of PFAS (per and poly-fluoroalkyl substances) in their properties, regardless of whether contamination has been confirmed. The bill amends NH RSA 477:4-a to include PFAS in the list of contaminants requiring disclosure, alongside radon, arsenic, and lead. NH House Bill 1304, Relative to Vessel Registration and Boat Fee Decals:

The bill mandates that boaters display a new decal when registering their boats. New Hampshire residents will receive two sets of decals instead of just one—the new policy results from a Coast Guard audit recommending a different method of collecting boat fees. NH Senate Bill 255 Relative to The Expectation of Privacy:

The “NH Data Privacy Act” outlines new consumer rights for personal information in the hands of businesses. Individuals have the right to confirm if a business controls their personal data, including correcting inaccuracies, deleting it, and opting out of future personal data processing. If a company doing business in New Hampshire doesn’t comply, individuals can seek civil penalties of up to $10,000. Additional information is available on the NH Department of Justice website.

IRS ISSUES STANDARD MILEAGE RATES TO 70 CENTS PER MILE FOR 2025

Effective January 1, 2024, the standard mileage reimbursement rate for transportation expenses as set by the IRS has increased to 70 cents per mile (up 3 cents from 2024). This new rate applies to reimbursement payable under RSA 281-A: 23 Medical, Hospital & Remedial Care. The New Hampshire Department of Labor generally adjusts this rate on January 1 of each year.

Workers’ Compensation Carriers should use this rate to reimburse eligible Workers’ Compensation travel expenses incurred on or after January 1, 2024.
