Abramson, Brown & Dugan has officially filed a civil lawsuit against Elliot Hospital in Manchester, NH. The complaint alleges severe misconduct and negligence arising from the sexual assault of a four-year-old pediatric patient by a hospital employee in late 2025.

"Hospitals have a fundamental duty to safeguard their most vulnerable patients," says Attorney Nick Abramson. "We intend to hold accountable those whose actions or failures allowed this abuse to occur."

We are proud to share a significant milestone in the pursuit of justice for victims of medical negligence. Abramson, Brown & Dugan secured a pivotal ruling from Judge David Anderson of the Hillsborough County Superior Court in New Hampshire, denying Catholic Medical Center’s (CMC) motions to dismiss wrongful death lawsuits on behalf of the families of John William Queen and Myron Louis Bishop, Jr.

Following a 2024 Boston Globe Spotlight investigation exposing CMC’s failure to address cardiac surgeon Dr. Yvon Baribeau’s history of errors, the families filed suit. The court applied New Hampshire’s discovery rule, recognizing claims can proceed when negligence is uncovered years later.

The ruling sets critical legal benchmarks on several issues of first impression in New Hampshire, including the application of the discovery rule to wrongful death claims, rejection of rigid time limits (repose periods) for filing wrongful death claims, recognition of institutional accountability for medical negligence, and recognition of negligent credentialing as a standalone claim in New Hampshire.

This triumph for transparency sets a vital precedent: hospitals must prioritize patient safety over reputation, and families deserve justice—no matter how much time has passed.
