Clarkson Law Firm filed a proposed class action against McDonald's USA in the Northern District of Illinois.

The complaint alleges that since at least 2019, McDonald's has run an algorithmic pricing engine fed by nonpublic transaction data from corporate and franchised restaurants. According to the complaint, McDonald's and franchisees share confidential business information to price menu items for individual locations, and McDonald's tracks and polices franchisees who deviate from those prices. The suit alleges that franchisees have been required since January to use the company's approved pricing tool.

McDonald's own fact sheets report average menu prices rose about 40% between 2019 and 2024. The complaint alleges the company told customers those increases reflected higher costs.

The suit asserts claims under the Sherman Act, the Illinois Antitrust Act, and the Illinois Consumer Fraud and Deceptive Business Practices Act on behalf of a proposed nationwide class and an Illinois subclass of people who bought menu items at McDonald's restaurants.

Partner Derek Brandt and Senior Associate Larkin Turner represent the putative class. Derek told Law360, "We look forward to standing up for everyday consumers" who are already stretched thin.

Two weeks.

That’s how long, according to the complaint, an AI model would typically allow elderly patients to stay in nursing home rehab before coverage denials began. It happened to patients recovering from falls, fractures, and heart surgery, even when their doctors said they needed more care.

Vox health correspondent Dylan Scott examined how health insurers use AI to decide who gets care. Clarkson Partner Glenn Danas, one of the attorneys in proposed class actions against UnitedHealth, Humana, and Cigna, spoke with Vox about what patients experienced.

The complaints allege:

UnitedHealth and Humana relied on an algorithm called nH Predict to end post-acute coverage for Medicare Advantage members

UnitedHealth employees were instructed not to deviate from the model’s projections

Cigna used an automated system to deny claims in batches of hundreds or thousands, without opening patients’ medical files

Many of the people affected are elderly. Glenn told Vox that most of them first learned an algorithm was involved on the day they were told to leave.

He and his clients hope the litigation helps in “putting the brakes” on AI’s use in insurance.

For anyone navigating a denial right now, Vox reports that a large share of denied claims are overturned on appeal.

Bystanders never agreed to be part of Meta's AI training data.

Earlier this year, we filed a lawsuit against Meta regarding its use of footage from its AI glasses, including recordings of people who never wore or bought them, to train its AI systems. The amended complaint alleges the company didn't disclose this to the bystanders who ended up on camera.

Ryan Clarkson, founder and managing partner at Clarkson Law Firm, is co-lead counsel on the case. He told Fortune the push for more AI training data comes down to power and money.

On September 24th, Clarkson Partner Kristen Simplicio joins the opening panel at Practising Law Institute's 31st Annual Consumer Financial Services Institute in Chicago. "Consumer Advocates and Consumer Protection Enforcers Speak in 2026" brings consumer advocates and consumer protection enforcers together to assess where protections stand for people facing unfair, deceptive, and abusive financial practices.

The panel will cover:

Millions of iPhone owners can now file for their share of a $250 million settlement, the largest known false advertising settlement fund in history.

Clarkson Law Firm was the first to bring suit over Apple's advertising campaign for its newest iPhones, which promoted an enhanced AI Siri that consumers say was not actually available at launch. Clarkson and Co-Lead Counsel secured a $250 million non-reversionary common fund to resolve the claims. There has been no finding of liability and Apple denies it did anything wrong.

If you purchased an iPhone 16 (any model), iPhone 15 Pro, or iPhone 15 Pro Max between June 10, 2024 and March 29, 2025, you may be eligible. The presumptive payment is $25 per device and could reach $95 per device depending on claim volume.
