Did you know in New York before a medical malpractice claim can be brought your lawyer must have the medical records reviewed by a health care provider in the same specialty as the proposed defendant?
And, that the medical practitioner who reviewed the medical records would need to opine that medical malpractice occurred which caused a serious injury before a claim can be commenced?
The investigation is a time consuming process.
Medical malpractice claims in N.Y. need to be started within 2 years and 6 months of the departure by the physician (some tolls apply).

During this prom season make sure to ask the Limo company you hire to send you a copy of its declaration page or limits of liability page. Make certain it's policy is commercial. Determine the limits amount in relation to tbe number of occupants. A million dollar policy does not cover it, in my opinion. Neither does the $1.5 million dollar minimum policy for 8 occupants. Reputable companies have more coverage and have umbrella policies too.
Here is New York's law, as of January 1, 2020: all for-hire vehicles with a seating capacity of 8 or more passengers must have a liability insurance policy with a combined single limit of at least $1,500,000.
This change impacted commuter vans, paratransit vehicles, stretch limousines, and any for-hire vehicle with a seating capacity of eight or more passengers. (Insurance Law § 3420(f) and VTL §§ 370(1)(a) and (b). Simply put, your hiring the Limo company. Ask for its declaration page and make sure you and your loved ones are adequately covered. I speak from professional experience. Trust me on this one when renting a Limo. The limits should exceed a few million, to be safe. In New York, if you're injured by an intoxicated person's negligence in a car crash you can bring a personal injury claim against that person. But in some situations, your options for a legal remedy don't stop there. An injured person may also be able to bring a claim against the host, home owner or business (such as the server's home, a bar or a restaurant). The injured person may bring a claim against the third party that provided the alcohol or substance to the intoxicated person. Claims of this type that are against alcohol servers and vendors are known as "dram shop" claims because alcohol used to be sold by a unit of measurement called a "dram." When a claim for an alcohol-related accident is brought against a social host who provided alcohol, it's sometimes called a "social host liability" claim.

Surgeons are responsible for performing complex surgical procedures on their patients. It is part of their job. A surgeon has the responsibility to do the surgery properly, within the standard of care. Every type of surgery requires a specific standard of care for the patient’s condition. All medical professionals have a responsibility to adhere to this standard of care for every patient. If a surgeon {or medical professional} commits a negligent error which causes the patient harm, the surgeon has committed medical malpractice and faces liability for the patient’s resulting damages. The mistake is never intended. But that does not make the mistake acceptable.
