Paying child support? Keep proof of every payment.

We often see clients who made payments but cannot prove it later. Avoid paying cash without a signed receipt. Consider using a separate checking account solely for child support so you have a clean, easy-to-produce paper trail. Most importantly, always follow the payment method required by your court order.

Your parenting schedule may also affect your child support obligation. If your current child support order does not account for the parenting time you are actually exercising, you may be entitled to a shared parenting time credit (reduction).

⚖️ Little Legal Tip: Even Your Own Insurance Company May Not Be On Your Side⚖️

After a car accident, many people think, “If I’m only dealing with my own insurance company, I probably don’t need a lawyer.”
Unfortunately, that is not always true.

Insurance companies — even your own — are businesses. Their goal is often to resolve claims as quickly and cheaply as possible, not necessarily to pay you everything you deserve.

That means they may:
🔹 ask for a recorded statement
🔹 downplay your injuries
🔹 question your medical treatment
🔹 undervalue your claim
🔹 pressure you to settle too soon

This is especially important in claims involving uninsured motorist or underinsured motorist coverage. Just because the coverage is yours does not mean the insurance company is automatically looking out for your best interests.

⚖️ Little Legal Tip: New Kentucky Laws Are Now in Effect⚖️

Several new Kentucky laws took effect this week, including important changes involving criminal cases, custody, concealed carry, and child welfare.

🔹 Logan’s Law changes parole eligibility and sentencing rules for certain violent offenders.

🔹 Kentucky’s stalking laws were strengthened. Stalking is now generally a felony and may include repeated texts, social-media messages, electronic tracking, and surveillance.

🔹 Kentucky created a new grooming offense involving conduct intended to prepare a minor for sexual activity.

🔹 Certain offenses involving sexual images of minors may now include AI-generated images and require offenders to serve at least 85% of their sentence.

🔹 Kentucky residents ages 18 to 20 may qualify for a provisional concealed-carry license after completing training and passing a background check.

🔹 Family courts must continue deciding custody based on the best interests of the child. The new law gives courts clearer authority to consider domestic violence and safety concerns when determining custody and parenting time.

🔹 New child-welfare laws strengthen protections involving foster placements, substance-exposed children, and Cabinet investigations.

🔹 Students in grades 6 through 12 may face mandatory expulsion for certain serious offenses involving weapons, threats, or violence.

Kentucky laws are constantly changing. Knowing your rights—and how a new law may affect your family or your case—is important.

Back by popular demand…Did you know? In Kentucky, there is a presumption that it is in a child's best interest for both parents to share joint custody with equal parenting time when you initiate a divorce or custody action.

That does not mean every case results in a 50/50 schedule. Every family is different, and the Court will consider the evidence presented. If there are circumstances that make equal parenting time inappropriate, it is critical to have credible evidence and be prepared to present your case.

Walking into the courtroom and hoping the Judge "just knows" your situation is never enough. Preparation matters. Evidence matters. Knowing the law matters.
