💡 Little Law Office Tip: Expungements ⚖️

Did you know that even when a criminal charge is dismissed, it may still remain on your record? That can include something as simple as a speeding ticket🚗

For years, many people have come to our office believing that a dismissal automatically meant their record was cleared—but that simply wasn’t true. (We make sure our clients understand the expungement process and their rights from the beginning).

✅ Kentucky law now provides that cases dismissed with prejudice or acquittals on or after July 15, 2020 are automatically expunged after 30 days (excluding traffic cases). No action is required by the defendant. But not every case qualifies automatically—and many people still have old charges sitting on their record without realizing it📂

👀 One of the best things you can do is request a certification/background check and take a look for yourself.

⚖️ Little Legal Tip– Kentucky Estate Planning💡

Married with children and no will? Your property may not pass the way you expect.

Under current Kentucky law, if someone dies without a will (intestate) and their deed is not held in survivorship, the surviving spouse generally receives one-half of the estate, with the remaining half going to the decedent’s children.

🏡 Your deed matters. How your deed is written can be just as important as having a will:

With right of survivorship: property passes automatically to the surviving owner.

Without survivorship: the deceased spouse’s share passes to both the surviving spouse and the children—meaning the surviving spouse could end up co-owning property with them.

We’ve seen this firsthand. Last year, we had to deliver this difficult news to two widows. Because their property was not in survivorship, they unexpectedly became co-owners with either their own children or their spouse’s children from a prior relationship. In one case, the children even moved to force a sale of the home.

Key takeaway: If you want your property to pass directly to your spouse, make sure your deed is properly titled with survivorship or you have a Will.

👉 Important update: Kentucky enacted significant changes to intestate succession during the 2026 Regular Session through SB 50. Once the new law takes effect, a surviving spouse will inherit the entire estate when all children are shared with the decedent. If there are children from another relationship, the estate will still be divided.

We’re going to say this as clearly as possible:
👉 Do NOT consent to searches.

In criminal cases, prosecutors (like the County Attorney or Commonwealth’s Attorney) bring charges—and defense attorneys step in to protect your rights.

And remember—good people make mistakes. Many of our clients never thought they’d be in that position.

Here’s what we see: A routine traffic stop turns into, “Do you mind if I take a look?”
It sounds casual—but it matters.

That’s a request.
And you have the right to say:
“I do not consent to any searches.”

Even if you think there’s nothing in your car—are you 100% sure?
A friend or passenger could have left something behind without you knowing. We’ve seen small situations turn into big legal problems fast.

If law enforcement has the legal authority, they’ll proceed with a warrant or have other legal grounds. But if they don’t—your consent is what opens the door.

Know your rights. Use them. It matters.

👉 If you have a divorce/custody case, you must file a Notice of Relocation with the Court and other party anytime you move 📄

And yes—that includes:

- moving across town 🚗
- changing apartments 🏢
- even relocating next door 🏠➡️🏠

The distance doesn’t matter. The legal requirement does.

Skipping this step can:
- impact your rights ⚠️
- cause delays in your case ⏳
