🚛 SCOTUS Rules 9-0: Freight brokers can now be sued in state court for negligent hiring.

In Montgomery v. Caribe Transport II, the Supreme Court made a ruling that will have a significant impact on trucking accident cases.

A freight broker — the middleman who connects shippers with trucking companies — can no longer hide behind federal law when they put dangerous carriers on the road.

In this case Shawn Montgomery lost his leg when a truck crashed into him. The defendant broker had hired a trucking company with a poor safety rating.

SCOTUS said: that's on the broker too.

Why does this matter for victims?

Trucking companies may carry only the minimum $750,000 in insurance — rarely enough for catastrophic injuries. Brokers now represent an additional source of recovery in trucking accident cases.

The message to the industry is clear: "cheapest carrier wins" is no longer a safe business model. Vet your carriers — or face the consequences in court. ⚖️
