What is the difference between a Ladybird Deed and a Land Trust?

A Ladybird Deed only avoids probate. This allows the owner to maintain full ownership and control of the property during their life, and will not affect Medicaid eligibility. The owner can also change their mind and remove the remainderman from the deed without their consent. However, when the owner dies, any judgments against the remaindermen can attach to the property if homestead is not maintained.

As for a Land Trust, this avoids probate, but also provides privacy and asset protection for the beneficiaries. The asset protection piece is the biggest difference between a Land Trust and a Ladybird Deed. Along with this, there is more flexibility to add multiple layers of successor beneficiaries. A Land Trust is managed by a trustee, which can be different from the beneficiaries and provides convenience and professional management of the property.
