As we head into warmer months of the year (though these apply at all times), do you know the rules for leaving your children in a dwelling or locked vehicle? Here is what the Maryland Rules say:
ยง 5-801. Confinement in dwelling, building, enclosure, or motor vehicle
(a) In general. -- A person who is charged with the care of a child under the age of 8 years may not allow the child to be locked or confined in a dwelling, building, enclosure, or motor vehicle while the person charged is absent and the dwelling, building, enclosure, or motor vehicle is out of the sight of the person charged unless the person charged provides a reliable person at least 13 years old to remain with the child to protect the child.
(b) Penalties for violation. -- A person who violates this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $ 500 or imprisonment not exceeding 30 days, or both.
What does this mean? A child under that is under the age of eight (8) cannot be locked in a dwelling, building, etc. or motor vehicle that is out of the sight of the person entrusted to care for him/her unless someone 13 or older is present to protect the child. So, in short, don't leave your littles in a car by themselves. Don't leave them home alone unless they are over eight and have the maturity to be home alone. And, siblings who are under 13 cannot watch them for you.
