Kentucky's legislature just passed two bills, HB 568 and HB 355, that effectively ban public adjusters from negotiating insurance claims on behalf of policyholders.
Public adjusters work on contingency for ordinary homeowners who cannot afford an attorney for a $40,000 claim dispute. They exist because that gap exists. These bills eliminate them.
As an attorney who has handled policyholder disputes for years, I have regularly referred cases to public adjusters when the claim did not justify attorney rates but the policyholder still needed an advocate. I know what this profession does for ordinary Kentuckians.

We had a strong hearing this week, and we’re going to keep fighting this as long as it takes. Families in Kentucky deserve clear laws that don’t force them into fear, confusion, or impossible medical decisions.

If the statutes were really as “simple” as the state claims, we wouldn’t be three years into this case, patients wouldn’t be delaying IVF, and no one would be wondering whether discarding unused embryos could somehow make them a criminal. That’s not clarity — that’s chaos.

I’m deeply grateful to Jessica Sky for her courage, and to Lisa Sobel and Sarah Baron for leading the way from the beginning. And I’m honored to work alongside my co-counsel, Benjamin Potash, whose commitment to justice has never wavered.

We don’t have to accept the status quo. This is our community and our Commonwealth, and we can change it.

We're thrilled to announce that the Kentucky Court of Appeals has REVERSED the trial court's dismissal in Sobel v. Coleman!
Our client Jessica Kalb's case challenging Kentucky's unclear abortion laws and their impact on IVF treatment is back on. The Court of Appeals recognized that Jessica, who has 9 frozen embryos and canceled a scheduled implantation due to legal uncertainty, has standing to determine whether she will be prosecuted for murder if she disposes of any of her embryos.
This is a significant win for reproductive freedom and the right to access IVF without fear of criminal prosecution. The case is now remanded for further proceedings!

On June 11, my co-counsel Ben Potash delivered oral arguments before the Kentucky Court of Appeals in Sobel v. Cameron — a case that could help restore the rights of Kentuckians who need reproductive technology to grow their families and who practice faiths that differ from the theology embedded in the state’s abortion laws.

We represent three courageous Jewish women — Lisa Sobel, Jessica Kalb, and Sarah Baron — who are challenging Kentucky’s restrictive abortion laws. These laws not only threaten their ability to safely pursue IVF but also violate their religious freedom under the Kentucky Constitution.

We asked the court to reinstate our clients’ standing to bring this case forward because their medical histories and their religious beliefs deserve to be heard in a court of law.

“Our clients hope that the Court of Appeals will affirm their deeply held concerns as mothers who rely on reproductive technology to build their families safely, and recognize the theological nature of the current laws, which impose one belief system over others.”

While we don’t expect a ruling on standing immediately, we remain committed. If standing is restored, we’ll return to Judge Edwards to argue the full merits of this case.

Judge Edwards’s decision to deny our clients’ standing is disappointing. After waiting thirteen months for a ruling, we received a nine-page opinion that made numerous obvious errors. The Judge relied on bad, irrelevant law and a non-binding promise from the Attorney General’s Office. This does not make our clients or the IVF community safer. Our nation is waiting for a judiciary brave enough to do what the law requires. Our clients demand that we continue the fight, and we look forward to a review by higher courts.

We are deeply disappointed by Judge Edwards' decision to dismiss our lawsuit on the grounds of standing. This ruling overlooks critical issues central to our case, which are of profound importance to countless individuals and families across our state.

Our lawsuit sought clarity on complex legal questions regarding the confusing anti-abortion laws spanning over 80 pages and written across the past 50 years. These laws intersect and sometimes conflict, and it is crucial for our judicial system to address how they should be applied so that families like ours going through assistive reproductive technologies such as IVF and our doctors know what is and is not legal. We should not have to go through the emotional process that is financially costly before we find out we may have to leave the state or face prosecution because we have non-viable pregnancies or embryos we cannot use.

Furthermore, our case also raises fundamental questions about the religious dimensions of laws concerning when life begins. These are abstract religious arguments that are deeply personal and moral questions and deserve careful consideration but should not be codified in written legislation that governs our state.

It is regrettable that Judge Edwards' ruling did not engage with these substantive issues. By focusing narrowly on procedural grounds, the opportunity to provide clarity and guidance on these significant matters has been missed.

We remain committed to pursuing justice and clarity through the legal process. Our fight continues, not just for ourselves but for all those who seek fairness and understanding in matters that touch upon the very essence of life and law.
