After three and a half years, we have a positive ruling from the circuit court in our reproductive freedom case. Judge Edwards sided with us and struck down the legal definition of life beginning at conception. He agreed that these statutes are overly vague and unintelligible, and that the Kentucky legislature has failed to provide meaningful definitions to put women on notice as to what they can even do with their own bodies. As a result, the trial court has struck down numerous definitions from Kentucky's patchwork Abortion Law.

We're pretty sure this means that IVF is unequivocally safe and legal in Kentucky. It certainly has other consequences as well. We know this has major implications, but we are not quite sure yet exactly what this means. The future is unwritten.

The government will almost certainly appeal and try to reinstate life at conception. In that case, it's likely that we will too. Judge Edwards did not agree with our religious claims, and while his opinion was studied and well-argued, we don't agree with his Order in that regard.

Despite this, we consider this the best news for Reproductive Freedom in Kentucky for many years.

Earlier this week, we returned to Judge Edwards’ courtroom to address a fundamental problem in Kentucky law: our abortion and embryo statutes are vague, internally contradictory, and impose a specific religious doctrine on people whose faith does not share that view.

Our client, like many IVF patients and like most American Jews, does not believe that unimplanted embryos are human beings. Under Jewish law, she should be able to dispose of nonviable embryos and receive appropriate medical care without fear of prosecution. The state’s definition of life at conception denies her both clarity and religious freedom.

Jessica expressed it powerfully:
“We all want to be able to safely have children in Kentucky. And right now, we can’t. I can’t. We keep focusing on the non-life in a petri dish instead of the life that is here — me, my life as a mom, my daughter who deserves to have a mom.”

We appreciate Judge Edwards’ serious engagement with the issues and look forward to his ruling.

A judge heard lawyers’ arguments Monday in a years-long lawsuit brought by a Jewish woman against Kentucky’s near-total abortion ban. A ruling could happen soon.

In an unequivocal 3-0 decision, the Kentucky Court of Appeals held that our client Jessica Kalb has standing to challenge Kentucky's tyrannical abortion laws. The decision overturns a trial court decision that ignored a very real injury to our client. The talking heads and the experts all told us it was over, but truly, it has not even begun. We will not stop until reproductive freedom returns to Kentucky.

On June 11, I delivered oral arguments before the Kentucky Court of Appeals in Sobel v. Cameron — a case that could help restore the rights of Kentuckians who need reproductive technology to grow their families and who practice faiths that differ from the theology embedded in the state’s abortion laws.

My co-counsel, Aaron Kemper, and I represent three courageous Jewish women — Lisa Sobel, Jessica Kalb, and Sarah Baron — who are challenging Kentucky’s restrictive abortion laws. These laws not only threaten their ability to safely pursue IVF but also violate their religious freedom under the Kentucky Constitution.

We asked the court to reinstate our clients’ standing to bring this case forward because their medical histories and their religious beliefs deserve to be heard in a court of law.

“Our clients hope that the Court of Appeals will affirm their deeply held concerns as mothers who rely on reproductive technology to build their families safely, and recognize the theological nature of the current laws, which impose one belief system over others.”

While we don’t expect a ruling on standing immediately, we remain committed. If standing is restored, we’ll return to Judge Edwards to argue the full merits of this case.

This fight is far from over — but neither are we.

Louisville attorney Ben Potash said "federal law is really easy to understand."

"Ma*****na is a schedule 1 narcotic," he said. "It is absolutely illegal."

Ma*****na is scheduled in the same class as he**in and L*D.

"There is no way that a university like the University of Louisville or Bellarmine, that depends on federal money will ever allow the breaking of federal law on campus," Potash said. "It's just a non-starter."
