After three and a half years, we have a positive ruling from the circuit court in our reproductive freedom case. Judge Edwards sided with us and struck down the legal definition of life beginning at conception. He agreed that these statutes are overly vague and unintelligible, and that the Kentucky legislature has failed to provide meaningful definitions to put women on notice as to what they can even do with their own bodies. As a result, the trial court has struck down numerous definitions from Kentucky's patchwork Abortion Law.
We're pretty sure this means that IVF is unequivocally safe and legal in Kentucky. It certainly has other consequences as well. We know this has major implications, but we are not quite sure yet exactly what this means. The future is unwritten.
The government will almost certainly appeal and try to reinstate life at conception. In that case, it's likely that we will too. Judge Edwards did not agree with our religious claims, and while his opinion was studied and well-argued, we don't agree with his Order in that regard.
Despite this, we consider this the best news for Reproductive Freedom in Kentucky for many years.
