Have you ever wondered what a Domestic Violence Protective Order is and how it works in North Carolina?

A Domestic Violence Protective Order is an order of the court that is entered ex parte. Ex parte simply means without the other party present. When a person is a victim of domestic violence, whether that be physical, mental, emotional, or financial abuse, a person can go down to either the courthouse or the magistrate's office and swear out a Complaint for Domestic Violence.

If you do this ALONE and without representation, you MUST put all the relevant facts regarding these issues directly into the complaint. If you fail to put everything that is relevant, you may not be able to move forward on those issues in court.

From there, a judge or a magistrate will hear your complaint in open court or in front of the magistrate and you will have to tell that person why you should get an order. If that person agrees, then an order will be entered on your behalf. From there, the paperwork needs to be served on your former partner. Once it is served, then a whole new process begins.

The main protection that you can receive is one year of protection via not having to talk or be around the party who harmed you. There are other things that could occur, as well.

It's been a fast and furious start to 2026 over here at Ascendo Legal.

In January, we had 5 trials. Of the 5, 4 were outright wins and one was a partial win. The client in the 5th case was found responsible for the action stated, however, an order to stop doing that thing was only entered for 6 months when it could have been a year.

We stand with our friends in the immigrant community and will continue to help all who are in need.

As we prepare for snow/icemageddon 2026, please remember your neighbors that are struggling. If you have a spare blanket, donate it.

This February our office will be collecting donations of new and gently used jackets and blankets and new hats and gloves. We will also be collecting food for our hungry friends and donating that food to local food banks. Help us help others.

At the close of business on the 18th of this month, we will be closing for a much needed break to celebrate the birth of Jesus with our families. We will return on Monday, December 28. As many of you know, my main business is being an attorney. I represent people charged with crimes, people who have been injured, people who are going through trauma because of the breakup of a family, amd people who are planning what happens after they leave this earth.

I represent people from all different walks of life: from multimillion dollar business owners to those who are homeless and struggling to survive. From those full of hope and love to those you feel like life isn't worth living anymore. From those struggling in the throes of addiction and self-harm to those who have conquered these demons. And a myriad of other folks.

We represent people who are young and old; well experienced in life and naive; who are judgmental and who have been judged; innocent and guilty; loved and hated.

But ultimately, who we represent are people. Flawed, imperfect, hurting, scared, desperate people. People on the top of the world and people down in the dumps of life. And we treat them all the same. Why? Because they are people and we are all humans. A person does not lose his or her humanity based on their circumstances, their charges, their past, their skin tone, their sexuality, their creed or religion, or any other reason. People are and always will be people.

We love them for who they are. Sometimes that is challenging and I'm sure they don't always like what I have to say because I'm not the lawyer who will tell you it's going to be OK if I know it won't be. I'm going to be real and honest with you from the moment a consultation is scheduled until the day the case is closed, I and my staff will be honest with you. If we make a mistake, we will own it. If we have good news, we will tell you. If we have bad news, you'll know it. Why? Not only is that my duty, but it's part of being human. You are paying me your hard earned money. The least I can do is be honest with you the entire time.

This job can beat you down from time to time, but I remember that, at the end of the day, my job is to love all my clients as Jesus loves me and treat them like that even if it's hard, inconvenient, or painful for me. They deserve it. Why? Because they are humans. They have emotions. They are scared and pained.

Ultimately, I view my job as a liaison between the law and love. If we all loved each other a little more, the ugly in this world could dissipate nearly immediately. It isn't hard to be kind. It isn't hard to be compassionate. It isn't hard to love someone. Do it. Carry it with you. Put it into practice.

I challenge each of you to love your neighbor today more than you did yesterday. It doesn't have to be a grand gesture. It can be as simple as saying hello to someone or sharing a smile. It can be as complex as a long conversation. Just love one another. Then carry it forward into your business or work world. The world will change and we can be that change.

This isn't idealistic; it's honest. Love and it will be returned.

That's my challenge to you.

With the spirit of giving being high in the air, I am pleased to announce that we have alrwady given out all 5 of the $100.00 gift cards to Food Lion.

Thanks to some very generous donations, we are able to purchase some more of these gift cards and will have 5 more available this afternoon at my office.

Please keep the donations coming. Again, all of the donation money will go towards Care and Share unless a person specifies that their donation is to go towards grocery cards.

I love all of you and am proud to call you my friends and neighbors. Let's keep it up and keep helping those who are struggling this year.
