I just learned that Elon Musk is suing OpenAI. I asked OpenAI to analyze the complaint and give me an opinion on whether the plaintiff is likely to succeed on his claim, and this was OpenAI's analysis: Based on the information provided in the document, it appears that the Plaintiff has a strong case for breach of contract against the Defendants. ​ The document outlines the Founding Agreement of OpenAI, Inc., which clearly states that the corporation would be a nonprofit developing AGI for the benefit of humanity and would seek to open-source technology for the public benefit. ​ However, the document also describes how OpenAI, Inc. has deviated from this mission by licensing its technology exclusively to Microsoft, keeping the internal design of its models secret, and allowing Microsoft to exert control over the company. ​ These actions are in direct violation of the Founding Agreement and the Plaintiff's contributions to OpenAI, Inc. ​ It is likely that the Plaintiff will succeed in proving that the Defendants breached the contract and seeking damages or specific performance.
