DACA is restored but now it's up to USCIS to do the right thing and accept applications. We are eagerly awaiting for them to announce they will begin accepting initial applications. DACA recipients who got a 1 year permit will also be able to get a new 2 year permit but no word on how that will work. Check out NILC for the latest info.

DACA decision out today! Supreme Court ruled that the government did not rescind the DACA program in accordance with the Administrative laws the govern. Lots of questions remain. Check out these FAQ that Penn Law created below.

Does Today’s Decision Mean the DACA Can Never End?

No. Today’s decision is limited to how the DHS ended DACA in 2017. Specifically, the Court found that DHS failed to provide a reasonable explanation for ending DACA. How and if DHS chooses to proceed in the future (i.e., retaining DACA, issuing a new memorandum/explanation ending DACA, etc.) remains to be seen.

Did the Supreme Court Make a Decision About Whether DACA is Lawful?

No. The Court did not decide if DACA is lawful or a good policy. The decision is limited to “whether the agency complied with the procedural requirement that it provide a reasoned
explanation for its action.”

Can I submit an application for DACA for the first time?

The Supreme Court’s decision means that DACA should be fully reinstated, allowing for first time DACA requests. With that said, DHS will need to reopen the DACA policy for new requests consistent with today’s decision. However, this may not happen immediately.

I have DACA. Can I renew my DACA?

Yes. If you have been granted DACA before, you should be able to submit an application to renew
DACA.

I have DACA. Can I apply for advance parole that allows me to return to the country after traveling outside it?

The Supreme Court’s conclusion that DACA was terminated unlawfully means that advance parole should be reinstated. DHS will need to reopen the DACA policy for advance parole requests consistent with today’s decision. However, this may not happen immediately.

Ms. Urias graduated from the University of California at Davis School of Law in 2006 and has been admitted to practice law in California since 2007. Ms. Urias handles a variety of immigration matters (U Visa, VAWA, Humanitarian Parole, DACA, Advance Parole, I-751 Domestic Violence waivers, family-based immigration, the I-601A provisional waiver, asylum, and representation of individuals in immigration court). Ms. Urias is known for her kind, friendly demeanor with clients, excellent trauma-informed client interview skills, and creativity in formulating legal strategy.

Ms. Urias worked as a Staff Attorney at the United Farm Workers (UFW) Foundation, where she specialized in U Nonimmigrant Status Petitions (“U Visas”) and developed a Public Benefits Outreach Program for low-income immigrants to increase access for migrant workers and their families to food stamps and Medi-Cal as well as providing information on the intersection of public benefits eligibility and immigration status.

Following her work at the UFW Foundation, Ms. Urias worked as a Staff Attorney at the Los Angeles Center for Law and Justice (LACLJ). At LACLJ, Ms. Urias practiced predominantly family law, providing high-quality, free legal representation to low-income survivors of domestic violence and sexual assault in matters relating to child custody, restraining orders, child support, paternity, divorce, public benefits advocacy, and other services. Ms. Urias also represented survivors of domestic violence and sexual assault before USCIS via the U Visa, VAWA Self-Petitions, and DACA requests. Ms. Urias’ co-founded Phillips & Urias, LLP with Attorney Nora Phillips in 2014. Now, as the head of The Law Offices of Laura Urias, Laura remains committed to the migrant community in Los Angeles and beyond.
