Under California Labor Code §2775, the ABC Test presumes you are an employee unless your employer can prove all three parts of the test. Many workers in California are misclassified as “independent contractors” when they legally qualify as employees. Under the ABC Test in California Labor Code §2750.3, a worker is an employee unless the company can prove otherwise. Misclassification can mean unpaid overtime, missed breaks, and lost benefits.
