If you've lost money in a cryptocurrency scam, you absolutely must understand the role of crypto exchanges in order to have a successful recovery. So when we read that a major exchange like crypto.com has halted withdrawals due to suspicious activity, we know it's a good thing for fighting scammers.

But let's start with the basics.

What is a crypto exchange?

A crypto exchange is a platform on which you can buy and sell cryptocurrency. You can trade one crypto for another or to buy crypto using regular currency, otherwise known as fiat currency.

They simply offer that function and while there are some exceptions, most of them are not bad guys by any means.

That's correct, they are not bad guys. While, there are a number of fake ones and others that open and shut, by far and the large, crypto exchanges like Binance, Coinbase or Crypto.com are by no means bad guys.

These exchanges actually are very good about KYC compliance, or, in layman's terms, providing information about an account holder to law enforcement due to suspicious activity when asked to do so.

They are by far some the largest exchanges and, like their competitors, seek to be regulated in order to enter desirable markets around the globe. It is in their interest to prevent crypto fraud.

But then how do scammers manage to work through them?

It is very simple, They use exchanges as if they were regular crypto traders. The scammer tells you to buy it at one exchange and then you pay him with it. Now, what happens after that is not so typical. The scammer movers the crypto through the blockchain to be eventually cashed out at another or sometimes at the same exchange.

What they do in between those two exchanges will reveal criminal activity on the blockchain. They put your bitcoin together with others or split it up, put it through "tumblrs" or use other tactics designed to launder the coins. Once an exchange sees such suspicious activity after being subpoenaed by the police, it will hand over the information to the authorities. Your scammer is now cornered.

A Thai citizen who thought he had made off with 500 million baht (roughly $15 million) was arrested in Bangkok last week. The 50-year-old was one of the individuals behind the infamous Onecoin scam, and -- until he was caught -- he thought that he could evade the law.

Like many crypto scammers, he had defrauded millions by promising investors absurdly high returns on their investments. Not only did he guarantee them a whopping 400% return on their crypto, but he even allowed co-conspirators to run their own shady businesses on the Onecoin platform. They purported to sell houses, cars, land plots, gold, food supplements, cosmetic products, and clothes in exchange for crypto. It was all one big cryptocurrency scam on steroids.

But he could not hide behind the blockchain forever. The blockchain records everything. But had victims not approached law enforcement with blockchain analysis as part of their evidence, his arrest would never have been possible.

The hardest part about being the victim of a cryptocurrency scam is that it is easy to prove that you were scammed but it is very difficult to prove who scammed you. Why?
You have been the victim of a financial scam. That is easy to prove. The storyline is almost always the same: Somebody asked you to invest and pay with cryptocurrency, perhaps in several installments. Eventually, he refused to let you withdraw your funds or even just disappeared. You have emails and text messages that prove that.

You then take all that information and you go to the police to file a report, but they tell you that while they can see you have been defrauded they can't do anything about it. Why not? After all, you just gave them this huge amount of evidence showing how a very convincing scammer who masqueraded as a broker clearly committed a crime by stealing your crypto!

So what's the problem?
You don't know who actually took your money. You don't have a real suspect. What you have is a fake name of a fake or shell company that is of absolutely no use in identifying a real person or entity that took your coins.

So how do you get it back?
You follow their digital fingerprints through the blockchain. The blockchain is a digitally distributed, decentralized public ledger that exists across a network. It is the backbone of all cryptocurrency transactions.

Every transaction that flows through it has a distinct address associated with a specific person or entity, including your own crypto. By following that path, you will be led to an exchange where your cryptocurrency was cashed out. That exchange will provide police with the KYC (Know Your Customer) data of the person who converted your coin into fiat money. The KYC data includes that person's name, as well as contact information.

But, in order to do this, the police have to prove to the exchange that the money was involved in criminal activity. How do you do that? You get My Scamsolutions cryptotrace Report.

What you are looking at In the image is a modified sample path from a CryptoTrace Report. What it shows is that the path indicates criminal intent. What is the first sign?

Mixing lots of different bitcoin together and moving them through multiple addresses is one of several signs of crypto fraud. You will notice that the original 0.61734 bitcoin is mixed first with five bitcoins within a short time frame. This means that this person's bitcoin was probably combined with that of other victims who were scammed at more or less the same time. At that point, the scammer moved the mixed bitcoin to Kraken for him to cash out before it continues to the next hop. And right there is where you find your scammer.

Along with other information it contains, the CryptoTrace Report makes it obvious to the exchange that this person who converted the coin was engaged in criminal behavior. The exchange, therefore, turns over the suspect's KYC to the police, and police in that jurisdiction will question him and, if necessary, arrest him and put him on trial.

A man in Los Angeles was recently arrested on federal charges of defrauding victims of over $5 million in crypto investment scams between 2018 and 2021.

Every one of those scams involved a phony online platform. He set up one site, brought in roughly $850,000 in crypto, and then abruptly closed it. Afterwards he set up and ran another one until he hit that $5 million mark. And then he was arrested. Now he faces up to 30 years in prison and mandatory restitution. Restitution, in simple terms, means giving the victims back their money.

Why does this matter?
This is a textbook crypto fraud case.

A large number of cases that come to us regarding crypto fraud follow this pattern. Victims are taken in by the scammer, plead to get their money back, but the scammers ultimately disappears after shutting down their websites. Then they move on to set up another one under a different name.

This is important because you, the victim, have to understand that the company was not real. Nor was the the name given to you by anyone who spoke to you. What is more, they are not simply "gone." They are still around and they are the same people. And, those people are not immune from being caught because they can't truly hide behind the blockchain.
