California landlords, management companies and other housing providers: demanding that a tenant vacate rental property without following landlord-tenant laws and legal processes is unlawful, actionable and could amount to steep penalties.
While L.A. County's eviction moratorium expired earlier this year, tenant protections are still in place. No-fault evictions will remain illegal, and anti-harassment and retaliation protections are the law. Landlords must also serve written 30-day notices before filing evictions for nonpayment of rent that accrued since last July 2022.
A landlord may not use indirect means such as intimidation, harassment, refusing to make necessary repairs, changing locks, to force a tenant to move out.
In California, providers of residential housing must abide by habitability laws. Landlords and management companies are required to provide habitable rental apartments, houses, duplexes and homes for tenants. This obligation is often referred to as the “implied warranty of habitability" and it cannot be waived by a tenant or a landlord.
Various provisions of the California Civil Code outline the conditions that must be met to make a residence habitable and safe for tenants. These conditions include ensuring an operable heating system for the cold fall/winter months, functional electric, gas, and plumbing utilities, as well as installing proper locks, among other requirements. To be considered habitable under California law, a rental unit must have waterproofed and weather-protected roof and exterior walls, a water supply that produces hot and cold running water, and is connected to a sewage disposal system.
