Associate Attorney - Civil Litigation - 2-5 years experience

Compensation: $125,000 to $185,000 per year (plus commission)

Farivar Law Firm, a boutique law firm with an excellent reputation and diverse clientele, is currently seeking a 2 plus year associate attorney to join our dynamic civil litigation team. Responsibilities:

Manage a varied caseload, including drafting pleadings, discovery, motions, and briefs;

Participate in all aspects of civil litigation, including court appearances, depositions, negotiations, and mediations;

Effectively communicate with clients, opposing counsel, and court personnel;

Work closely with colleagues on case strategy, legal research, and analysis; and

Demonstrate a commitment to ongoing professional development, staying current on legal trends, and contributing to the firm's growth.

Requirements:

Juris Doctor from an accredited law school.

2 plus years of civil litigation experience, preferably with a focus on business law, employment defense.

Admitted to practice in State of California.

Exceptional research, writing, and analytical skills.

Excellent attention to detail and organizational abilities.

Strong interpersonal and communication skills.

A proactive and results-oriented mindset.

A commitment to upholding the highest ethical and professional standards.

Willing to work overtime and/or on weekends if necessary.

Unfortunately, many small businesses have been affected by COVID-19. The new rules and amendments to the current bankruptcy code - Small Business Reorganization Act (“SBRA”) and the “Coronavirus Air, Relief and Economic Security Act” (“CARES Act”) - allow businesses to survive, retain key employees and restructure operations. Some of the important changes to chapter 11 filings for eligible sub-chapter V individuals or a businesses are as follows:

• The unsecured debt limit has increased from $2,725,625 to $7.5 million (the original limit will return after one year);
• No creditors’ committee would be appointed in a case unless ordered by the court;
• No United States Trustee fees;
• Th debtor can file a plan which would not require voting by creditors;
• A debtor’s plan can modify a mortgage against a principal residence, provided that the mortgage loan was not used primarily to acquire the residence; and
• A debtor must file its plan (no disclosure statement is required) within 90 days of the bankruptcy filing (subject to extension under limited circumstances).

IR-2020-59, March 25, 2020 — To help people facing the challenges of COVID-19 issues, the Internal Revenue Service announced today a sweeping series of steps to assist taxpayers by providing relief on a variety of issues ranging from easing payment guidelines to postponing compliance actions.

To the extent employees need time off to, among other things, care for family members with COVID-19 or children whose schools or places of care have been closed, covered employers must follow the Family and Medical Leave Act (FMLA) as well as state and local equivalents, as well as all relevant paid family leave laws. The Families First CoronaVirus Response Act was just signed into law on March 19, 2020 providing additional protections for employees, requiring employers to fully comply with certain complicated rules in this regard.
