Almost every domestic violence trial in California comes down to one question.

It's not whether you did it. It's something much simpler than that, and most people never see it coming.

I've been trying these cases for over ten years, and the answer to that one question is what decides whether a jury believes you.

I walk you through the whole thing in my new YouTube video, including the case where I stumbled onto that answer at a preliminary hearing and won a not guilty on a felony.

If your case could ever end up in front of a jury, watch this one before you make any decisions.

Just got served with a restraining order? Start here.

You haven't had a chance to tell your side yet. The hearing is where that happens.

Most people walk in thinking the truth will be enough. It usually isn't. The person who understands how the hearing works has the advantage.

I made a free 19-minute class on how to fight it: what the judge is looking for, what evidence matters, and what to do first.

Your phone is ringing from a number you don't recognize. Should you pick up?

If you were arrested in the last few days, that call is probably not who you think it is.

And there's a version of that conversation that hurts you even when you're completely innocent and telling the truth.

After more than ten years of these cases, I can tell you the people who get charged are often the ones who tried hardest to explain themselves.

I cover both in my new YouTube video.

If your phone is ringing right now, watch this one first.

You showed the judge your texts, your photos, your video β€” and then sat down. None of it is in the record yet. One sentence fixes it: "Your Honor, I move to admit respondent's exhibits A through F into evidence." Say it before you sit down. Not legal advice β€” every case is different.

The temporary order says no contact β€” so you don't. Then your mom texts her. At the hearing that text becomes "he put her up to it," and a judge who believes you violated the order can grant the restraining order on that alone. Tell your family tonight: nobody texts her. Nobody. Not legal advice β€” every case is different.

The response form in your packet looks mandatory. It isn't, and I usually skip it. Everything you write, she gets weeks before the hearing to pick apart β€” and one detail said differently in court becomes "he's lying." Say it once, in court, prepared. Not legal advice β€” every case is different.

Her declaration was signed under penalty of perjury. When today's story doesn't match what she wrote, lock it in and stop: "You're absolutely sure it was the driveway? Isn't it true you wrote kitchen?" Don't ask which one is true. You're not proving a location β€” you're showing the judge she can't be trusted on either. Not legal advice β€” every case is different.

When it's her word against yours, you can't prove a negative β€” so stop trying. Ask what a real victim would have done: no police call, no doctor, not one photo. Never ask "why" β€” that hands her "because I was scared." Just list it and let the judge do the math. Not legal advice β€” every case is different.
