On January 26, 2023, the U.S. Department of Education announced the resolution of a pregnancy discrimination investigation of Troy University in Alabama.

The Office for Civil Rights (OCR) ran an investigation to determine whether the university appropriately responded to a student’s requests for pregnancy-related accommodations during the 2020-2021 school year.

OCR confirmed that the student notified the university of her pregnancy BEFORE the 2022 fall semester, and revealed repeated instances where the student experienced negative effects from a lack of pregnancy-related accommodations, such as:

🤰unable to fit in a classroom desk (the student requested a table, but never received one)
🤰penalized in a class for poor attendance
🤰received a failing grade in a class because she was DENIED the ability to make up work

Upon the concerns uncovered by OCR’s investigation, Troy University agreed to:

🤰train faculty and staff regarding rights to pregnant students
🤰track pregnancy-related adjustments and the university’s response
🤰update the university’s website to provide information about pregnant students’ rights
🤰provide the affected student adjustments to grades negatively impacted by the university’s handling of her requests and reimbursement for documented expenses related to courses she had to retake from the semester she was pregnant
🤰review and revise certain policies to ensure they comply with the Title IX of the Education Amendments of 1972

Today I want to honor all parents who have faced pregnancy or infant loss. The death of one’s child is the worst thing that could happen to a parent. No amount of words can express the pain that you are going through.

For those who haven’t experienced pregnancy or infant loss, please be aware of the words you use around people with uteruses. Comments like “you should have a baby” or “when are you going to make me a grandparent/aunt, etc.” pressure those who might want children but have experienced loss or infertility. You never know what people are going through.

If someone you know has experienced pregnancy or infant loss, here are a few things you can do to support the grieving family:
🕊 Be patient. There’s no right or wrong time to grieve.
🕊 Listen.
🕊 Ask what you can do to help.
🕊 Go to the baby’s funeral or memorial service.
🕊 Call, email, or send a card to let the parents know you’re thinking of them.
🕊 Understand if the parents aren’t happy or excited about other people’s pregnancies or the birth of other people’s babies.

If you have experienced pregnancy or infant loss, you should have the time and space to process your emotions in the way that’s right for you. The last thing you should have to deal with is an employer who is misinformed, indifferent, or unsympathetic. Many pregnant people are terrified to tell their employer about their pregnancy — more now than at prior points in history.

Do not be afraid: be informed. Here is what you need to know about telling your employer about your pregnancy.

🍼 You should tell your employer before you share the news with co-workers. 🍼
Of course, when to inform your boss varies according to your comfort level. However, from a legal perspective, earlier is almost always better when protecting yourself from discrimination and ensuring your medical needs are accommodated. In addition, if your employer learns of your pregnancy before you formally notify them, you give them a chance to create a record to justify any later adverse employment actions before you can prove they knew about your pregnancy.

🍼 You should tell your employer as soon as you need accommodations
or foresee the need for accommodations 🍼
Even though it may be awkward, you should tell HR or your supervisor if anything about your pregnancy is affecting or might affect your job performance. Your disclosure triggers your employer’s duty to try to accommodate you and requires them to disclose your rights under the PDLL.

🍼 Keep it constructive 🍼
Most women’s blogs recommend sharing the news in person or by phone. You know your workplace best: you should do what is comfortable for you. Legally, it does not matter how you share the news. Regardless of how you share the news, you should share your due date and ask for any critical information like who to talk to about benefits or maternity leave.

🍼 Confirm the news in writing 🍼
Whether you initially have an in-person conversation or not, you should ALWAYS confirm the news of your pregnancy in writing.

The PDLL, FEHA, and PDA require your employer to make “reasonable accommodations” for your pregnancy-related medical conditions.

What does that mean?

“Reasonable accommodations” means that employers must accommodate you if it doesn’t result in an “undue burden” on their business.

This is a high standard, and it is the employer’s burden to show that you cannot be accommodated.

The following are just examples of reasonable accommodations for pregnant workers:
- Additional or longer breaks to use the restroom, eat, rest, or check blood sugar;
- Time off for medical appointments;
- Help lifting heavy items and other restructuring of job duties to match medical restrictions;
- Modified equipment;
- Modified schedule or exemption from mandatory overtime;
- Working from home;
- Reassignment or transfer to another, less strenuous position.

If anyone else is granted the same accommodations you request, you should also be given the accommodations.
