Today, I receive an email from the daughter of a client. Her father has an appointment tomorrow to sign the four documents that I recommend for everyone, Will, durable financial power of attorney and prior medical directives, living will and health care power of attorney. I suggest that from everyone visit our website, nolanszabolaw.com , read my explanation about the four documents everyone needs.

The specific question concerned living will and health care power of attorney. What are they and the purpose of each document.

As long as a person can speak for himself/herself, he/she calls the shots and makes decisions as to medical care. The living will provides instructions for medical providers when a person cannot speak. Guidance when to withdraw medial care, no heroic measures, just comfort care, death is eminent.

The medical power of attorney is there when you can not make decisions. Your agent or agents know you well, have demonstrated good judgment and will listen to your medical provider about your diagnosis and prognosis. Your agent will make the critical decision as to care or to withhold care and to provide comfort care.

Assume Covid19 is with each and everyone of us.

This afternoon a client had an appointment at 2 pm to sign some documents for his father’s estate. My assistant call this morning to touch base.

He was not feeling well and needed to get tested for Covid19.

My office is using best practices, sanitizing, staff wearing mask, requiring masks, taking temperatures, asking β€œHow are you feeling today?”. Often washing our hands with soap and water. We have hand sanitizers easy to use.

Assume Covid19 is everywhere and with each and everyone of us at the least are exposed to it. Practice social distancing and wear a facial mask. Stay away from anyone and any place not using best practices to avoid being infected.

Often, I have a client ask me do they need a Will. YES, you should have a Will, preferably drafted by an attorney who practices elder law and estate planning. While I advise having a Will, I discuss how where appropriate using designation of beneficiaries as useful and efficient to transfer assets.

While it is sound judgment to have a Will, a person can an designate beneficiaries for most if not all of their assets as part of an estate plan. an estate plan guided by a professional.

You should have named beneficiaries and where permitted alternate beneficiaries for IRAs, 401 Ks, life insurance and annuities. Between spouses, property can be owned joint with right of survivorship.

Bank accounts can have beneficiaries designated. I advise not to name one beneficiary when you want the asset to be divided among a number of people.

For many families, using transfer on death designation affidavit for real estate is sound planning. TOD designation affidavits are not for everyone.

Last warning, designating beneficiaries does not work for everyone. Look at beneficiary designations periodically, revisions may be warranted. I will end as I began this post stating that you should have a Will drafted by a professional and discuss with the professional use of designation of beneficiaries.
