Even in these dark times, there is light. Today, we concluded an 8 year journey! My client came to me after being convicted of a crime in federal court. The crime made her mandatorily deportable, so pursued post-conviction relief with another attorney. It was denied and several years later she came to me. We overturned the conviction in 2/19 because her original attorney violated her constitutional rights! She finally won her immigration case last year and we applied for citizenship. Today, she completed her oath ceremony and is now a US Citizen! Personally, I could not be happier for this client, she had suffered so much but she stayed resilient and now she is a citizen.

Post-conviction can have benefits beyond immigration. My client had a felony conviction from right after he turned 18. The conviction caused several issues when he applied for scholarships, schools, and jobs. Today, we were able to reduce his felony to a misdemeanor under PC 17(b) and then dismiss the case under PC 1203.4 (commonly known as an expungement). Now the client’s record is clean for most professional and educational purposes, he can start pursuing his dreams!

Super excited for a very deserving client. She was arrested for a serious crime over 20 years ago. During her criminal case, her investigator got a confession from a co-defendant. He stated that my client had nothing to do with the crime. Despite the confession, her previous attorney encouraged her to plead guilty to a deportable offense. To make matters worse, he did not inform my client that she would be deported because of the crime. After 10 years, she learned that she was deportable and filed a post-conviction motion that was denied. Her appeal was denied as well. The client came to our office about 10 years after losing her appeal. Our motion discussed all of the errors and the People agreed to grant the motion. My client is now eligible for citizenship!

“My country isn’t accepting deportations…” is a phrase that I have heard from many foreign nationals from countries with no repatriation agreement with the US. To many in ethnic communities, like the Khmer community in Long Beach, the lack of a repatriation agreement is interpreted to mean “I cannot be deported.” This however, is not true. The immigration laws apply to everyone equally but whether deportations can be carried out may depend on the relationship between the foreign government and the US. This means that some people with deportation orders may not be deported, not because they are not subject to immigration laws, but because their home country will not accept them back. In these ethnic communities, many people accept plea deals to deportable offenses believing that they will never face deportation because of their foreign citizenship. However, if that country begins accepting noncitizens with deportation orders, those deportees will be removed, and in some cases, with little to no warning. Fortunately, we were able to address this misconception in a motion to vacate and avoid a cautionary tale. Now that my client’s record is clean and deportation proceedings are terminated, he can now apply for citizenship!

When the give moves to dismiss your client’s removal case that has been pending since before you started practicing law! In 2014, I briefed why my client was eligible for a waiver. I won. Another law firm never filed the waiver, so when the client came back to me after a different office filed for him, I sought termination of proceedings. The government opposed but agreed to let my client voluntarily depart the US. This time the judge denied the joint motion so we appealed and won. Post-appeal the judge wouldn’t be fair with my client so I threatened another appeal based on bias. Immediately, the judge started working with us and the government started opposing everything up through today’s hearing. Out of nowhere the government moved to dismiss….🤷🏻‍♂️

Today we had a federal conviction vacated based on inaccurate immigration advice at the previous plea hearing. She had been running with the wrong crowd, but had started her transformation long before she was arrested on federal charges. Despite her volunteering with Homeboys and Homegirls (where she is now a manager of Homegirl Café), she es convicted of an offense that would cause deportation. When she got out of prison she went right back to working at Homeboys. We filed this case in October, 2019 and finally resolved it today. Afterwards, we enjoyed lunch (and the sandwich named after her) at Homegirl Café. It was great to see the respect and admiration she earned from her peers, but the highlight of the day was when the judge praised her success and said that she “has little doubt that [my client] will not accomplish all she sets her mind to.”

A little late on the post, but I have something to be grateful for going into the holidays! Those of you who know me know that I’m a “control freak” when it comes to my job. I spend endless amounts of time crafting my arguments, anticipating the opposition’s arguments, and figuring out how each particular judge will interpret both sides’ positions. The worst hearings for me are the days when all that goes out the window on certain applications because it all comes down to the judge’s worldview. In this case all we had was an unconventional argument and I was nervous of how things would turn out, but every once in a while we get lucky. And lucky we got! The prosecuting attorney saw the situation for what it was and faithfully applied the facts to the law. And now my client is in queue for his green card.

What an incredible day in finishing my client’s case! He came to the US at 13 and his mother didn’t enroll him in school until 15. He had a rough time being funneled through the school’s ESL program. He picked up 3 convictions between 89-90 that haunted him until today. These three convictions prevented him from getting his green card despite learning English in community college, graduating undergrad and getting his MSW. To proceed with legalizing my client filed 4 motions to vacate, all of them were denied. He told me that he became an Amazon delivery person during the holidays to pay his legal bills during that time. He kept his faith that things would work out. We met last year and I told him that I thought I could help. He placed his faith in me and in August we received a non-opposition on two convictions. Today, the DA joined in the motion to dismiss his last case and he spoke with my client before the hearing. He told my client it was an honor to join in the motion because he was one of the few “success stories” in his line of work. It was such an honor to represent this man. He represents the best of the American Dream.

Sometimes the best thing to do is wait…. We filed the client’s motion to vacate well over a year ago but I didn’t want to set it for a hearing because we were assigned to a rough judge and had a rough DA. Initially, the DA looked like it was opposed to granting the motion. After nearly a year of negotiation, we got the disposition we were looking for. Moral of the story is that when you’re selecting an attorney it’s good to evaluate their black letter law competency and their understanding of the particular court where your case will be heard!

Great result today for second chances. My client has been a permanent resident for over 3 years! He found himself in deportation proceedings 16 years after his last petty theft conviction. We explained to the judge that the positives of taking care of his autistic grandson, his children, finishing multiple AA degrees, and beautifying his neighborhood outweighed his petty theft convictions. Based on the evidence and testimony, the judge was compelled to grant the application to stop his deportation. Now off to apply for citizenship!

There are 1.5 million immigration cases are pending before the immigration court. His only application for relief from deportation was for a waiver that is only granted 4,000 times per year. Today, after 11 years, he learned that he would have his waiver granted. The judge commented how impressed he was that he worked his way from a cart boy at CVS to a store manager. He also admired how he cares for his mother (also pictured). This client has and continues to shoulder a tremendous amount of responsibility in caring for his family while simultaneously taking advantage of all of this country’s opportunities. True to form, he went back to work after court. Congratulations to you and your family.
