FINAL APPROVAL AND JUDGMENT IN CLASS AND PAGA REPRESENTATIVE ACTION SETTLEMENT OF $1,500,000.00

On February 20, 2025, the San Bernardino County Superior Court, Hon. Christian Towns, GRANTED Plaintiff's Motion for Final Approval of a Class Action and PAGA Representative Settlement in this action in the amount of $1.5 million. See attached COURT ORDER.

The individuals who will receive settlement payments as part of this settlement include all individuals who worked (currently and formerly) for Hungry Panda US, Inc. in California as an independent contractor in the title of Driver, Contractor, or other similar titles/duties who performed deliveries for HungryPanda during the timeframe of September 2, 2017 to May 9, 2023. This settlement provides relief for, among other things, unpaid wages, penalties and for PAGA penalties. HungryPanda has agreed to this settlement without admitting any wrongdoing and final payment of the settlement sum will be made in August of 2025 with payments to affected class members being made shortly thereafter.

On May 9, 2023, the San Bernardino Superior Court (Hon. David Cohn) GRANTED plaintiff's request to have the class certified and proceed as a class of food delivery drivers who were not paid all amounts owed while driving for Hungry Panda. We believe that there may be over 1,000 individuals who have worked for Hungry Panda in California from September 2, 2017 to the present and are owed significant unpaid wages and reimbursement for business expenses. If you worked for Hungry Panda as a deliver driver during this timeframe, you may be entitled to significant unpaid wages and penalties. Please contact our office.

IMPORTANT UPDATE: The $725,000 judgment entered by the Court on October 4, 2022 remains unpaid by Defendant Fan Tuan and continues to accrue interest at 10% and additional fees and costs.

On June 1, 2023, we intend to file an involuntary bankruptcy proceeding in the United States Bankruptcy Court for the Central District of California to begin the immediate liquidation of any and all assets of Fan Tuan to pay all outstanding creditors, including the class members in this case.

Please see this space for any and all updates on our liquidation and/or appointment of a receiver to oversee the payment to class members for oustanding judgment amounts.

On March 10, 2023, the San Bernardino County Superior Court, Hon. David S. Cohn, GRANTED Plaintiff's Motion for Final Approval of a PAGA Settlement in this action. See attached Notice of Judgment.

The individuals who will receive settlement penalty payments as part of this settlement include all individuals who worked (currently and formerly) for Siemens Healthcare Diagnostics, Inc. in California as an Account Executive, Account Manager and/or similarly titled sales employees between June 28, 2019 through approximately December 11, 2022 and all nonexempt employees who worked for Siemens (current and former) in California from July 15, 2020 through December 11, 2022. This settlement provides relief soley for PAGA penalties and does not resolve any individual claims that the aggrieved employees may have against Siemens Healthcare Diagnostics, Inc.

Payments to all eligible individuals will be made in approximately June of 2023.

On October 4, 2022, the San Bernardino County Superior Court, Hon. David S. Cohn, GRANTED Plaintiff's Motion for Final Approval of a Class and PAGA Settlement in this action. See attached Notice of Judgment.

The individuals who will receive settlement and penalty payments as part of this settlement include all individuals who used Fan Tuan's online platform (i.e. mobile application) to perform delivery services as a courier or contractor in California at any time from July 1, 2019 through December 31, 2021. This case alleged that Fan Tuan delivery drivers/couriers were misclassified as independent contractors and should have received statutory minimum wage and overtime wages and reimbursement of business expenses.

Payments to all eligible individuals will be made in approximately 75 days.

DISTRIBUTION OF $3 MILLION PAGA PENALTY SETTLEMENT

The claims administrator, ILYM Group, Inc. (ilymgroup.com), who will be mailing penalty checks to aggrieved employees affected by this settlement has informed us that it has received funding of the settlment and will be mailing out checks on August 18, 2021. If you have moved or need to change your address since the last notice, please contact ILYM immediately at 888-250-6810.

The Exact Staff employees affected by this settlement include all nonexempt Exact Staff employees who worked at any of the four Target California Distribution Centers in the Inland Empire -- T-553, T-3806, T-3840 and/or T-9479 from June 3, 2018 to May 4, 2021.

IMPORTANT: 75% of the money allocated to employees will be sent to the State of California and 25% will be sent to the eligible employees. If you are affected by this settlement and are interested in determining if you have a claim for the actual unpaid wages/overtime (this settlement only covers PAGA penalties, not the wages potentially owed to you), please contact our office.
