We are delighted to share the Ninth Circuit’s opinion released today in 𝐵.𝐵. 𝑣. 𝐶𝑎𝑝𝑖𝑠𝑡𝑟𝑎𝑛𝑜 𝑈𝑛𝑖𝑓𝑖𝑒𝑑 𝑆𝑐ℎ𝑜𝑜𝑙 𝐷𝑖𝑠𝑡𝑟𝑖𝑐𝑡.

Those who have been following our work over the past few years will know that we had the privilege of representing the student plaintiff, B.B., in the district court.

The court held today that elementary school students cannot be stripped of their First Amendment rights simply because of their young age. Applying 𝑇𝑖𝑛𝑘𝑒𝑟 𝑣. 𝐷𝑒𝑠 𝑀𝑜𝑖𝑛𝑒𝑠, the Ninth Circuit vacated the district court’s grant of summary judgment and remanded the case for further proceedings.

It is a powerful decision vindicating the constitutional rights of students everywhere, and we are thrilled to see this result for B.B.

Major Supreme Court victory for election integrity.

Today, the U.S. Supreme Court held that candidates have standing to challenge unlawful vote-counting rules in federal court—before an election is over.

That matters to everyone who cares about lawful elections.

For years, courts dismissed challenges by saying: “You can’t sue unless you can prove the rule will change the outcome.” Federal courts would force litigants into state courts that refused to act or ran out the clock. That standard kept illegal election practices insulated from review until it was too late.

No longer.

The Court recognized a basic truth:
Elections are not legitimate if votes are counted unlawfully—even if the margin is large.

This decision means:

Illegal vote-counting rules can be challenged early, not after the damage is done

Courts can no longer hide behind technical standing barriers

Election integrity claims get heard on the merits

This is exactly the kind of structural accountability the Constitution demands—and exactly the work the Lex Rex Institute exists to do.

𝗙𝘂𝗻 𝗜𝗻𝗱𝗲𝗽𝗲𝗻𝗱𝗲𝗻𝗰𝗲 𝗗𝗮𝘆 𝗙𝗮𝗰𝘁 𝗳𝗿𝗼𝗺 𝗟𝗲𝘅 𝗥𝗲𝘅 𝗜𝗻𝘀𝘁𝗶𝘁𝘂𝘁𝗲

John Adams got it almost right.

In a letter to Abigail Adams on July 3, 1776, he declared:

"The Second Day of July 1776 will be the most memorable Epocha in the history of America."

He wasn’t guessing. The Continental Congress had voted for independence on July 2nd, thanks largely to Adams, who led the floor debate and rallied the votes behind the resolution.

He also predicted the occasion would be celebrated "with Pomp and Parade… with Shews, Games, Sports, Guns, Bells, Bonfires and Illuminations from one End of this Continent to the other from this Time forward forever more." In other words, parades, fireworks, and parties. He just had the date wrong.

The date on the Declaration of Independence? July 4, 1776.

The date Americans would celebrate with fireworks, speeches, and patriotic music? July 4th.

Adams was off by 48 hours — but considering he’s the one who fought tooth and nail to get independence through Congress, we’ll cut him some slack on the timing.

The Supreme Court’s decision to uphold Tennessee’s ban on gender mutilation for minors is a win for children, for parental rights, and for constitutional order. States have every right to stop irreversible harm masquerading as medicine, and today the Court affirmed that principle.
