Most people think estate planning is about the documents.

It isn't.

The documents are the easy part. What actually determines whether a plan works is everything that happens around them. How your house is titled. Who's listed as beneficiary on your accounts. Whether your trust actually owns what it's supposed to own. Whether your power of attorney is broad enough to handle long term care decisions if you can't.

A trust that was never funded is just paper. A will that contradicts your beneficiary designations doesn't control those accounts, the designation does. A power of attorney that's too narrow can leave your family stuck applying for guardianship at the worst possible time.

None of this shows up at signing. It shows up years later, when someone is in a nursing home, or has passed, or can't make decisions anymore.

Things I say in consults often enough that I finally wrote them on a whiteboard. And before you ask, no, they do not grade handwriting in law school.

A will does NOT avoid probate court.

Telling your kids what you want does NOT avoid probate.

Hiding the deed in a coffee can does NOT avoid probate.

Hope is NOT a plan.

The coffee can one happens more than you'd think.

Being "middle class" is the most dangerous place to be in the American healthcare system.

The very poor get Medicaid automatically. They have no assets to lose, so the nursing home gets paid by the state immediately.
The very rich pay privately. They have enough liquidity to cover $12,000 a month for care without impacting their lifestyle. They write the check and move on.

The middle class gets destroyed.

You worked for forty years at the plant or the office. You paid off your mortgage. You saved $300,000. You did everything right.
But $300,000 isn't wealth in the eyes of the healthcare system. It is just enough money to disqualify you from help, but not enough money to sustain you for long.

If you get sick, you are in the worst possible position.

The state expects you to spend everything you saved down to $2,000 before they help you. They expect your spouse to live on a fraction of the income. And the nursing home will pressure you about the house.

This is not a political statement. It is a math problem.
The math says you will go broke within three years unless you change the equation.

There are legal ways to restructure what you own so the state doesn't count it against you. But they only work if you do them before the crisis hits.

If you have between $100,000 and $1 million in assets, you are exactly who this system chews up.

Stop assuming the system will take care of you. It won't.
