On March 7th, 2022 Governor Gretchen Whitmer and Michigan Department of Insurance and Financial Services (DIFS) Director Anita Fox announced that the Michigan Catastrophic Claims Association (MCCA) will complete the transfer of $3 billion surplus in funds to Michigan’s auto insurers this week. Once this transfer is complete, it will trigger a 60-day deadline for these auto insurers to send $400 checks per vehicle to eligible Michiganders. Residents of the state can expect to receive these checks no later than May 9th, 2022.

On December 20, 2021, Governor Gretchen Whitmer signed into law 2021 PA 135. Under this bill, taxpayers who are shareholders or members of pass-through entities or certain trusts may choose to pay Michigan income tax at the entity level. The entity level has a tax rate of 4.25% and shareholders or members of such pass-through entities can then claim a credit on their Michigan individual income tax returns for their share of Michigan income taxes paid at the entity level (if this credit exceeds the tax amount, it can result in a refund).

On November 1st, 2021 Michigan Governor, Gretchen Whitmer, called upon the Michigan Catastrophic Claims Association (MCCA) urging them to return a $5 billion surplus through refund checks to every Michigan resident with auto insurance. "The over $5 billion surplus accumulated by the MCCA belongs to Michiganders and should be put in people’s pockets immediately with a refund check," Whitmer stated. If this surplus is returned, it is unsure when it will happen and how much Michigan residents will receive from the refund. The MCCA’s board is scheduled to meet again on Wednesday, November 3rd.

New legislation surrounding the cannabis industry was announced on September 14th, introduced as the Michigan Cannabis Safety Act. If this new legislation is passed, it will begin on March 21, 2022. The Michigan Cannabis Safety Act will reduce the number of patients allowed per caregiver from 5 to 1, as well as reduce the amount of plants a caregiver can grow at once from 60 to 12. If passed, caregivers will have to register for a Specialty Medical Grower license, these licenses will have a $500 application fee and caregivers’ ma*****na plants will undergo safety testing.

D’Wayne Edwards, a sneaker designer and educator from Portland, has plans to reopen the Lewis College of Business in Detroit, making it Michigan’s only operating Historically Black College or University (HBCU). The school will be reopened under the name Pensole Lewis College of Business and Design and was originally opened in 1928 but closed in 2013. Detroit’s College for Creative Studies is working closely with Edwards to help secure the needed approvals.

On October 1st a new law took effect which will lift license suspensions for roughly 73,000 Michigan residents who failed to pay tickets or court fines or failed to appear in court for certain non-moving violations, such as parking tickets. Drivers who have been affected by this will be able to use their existing license or immediately get a new one. The Michigan Department of State will be mailing letters to these impacted drivers, these letters will arrive within the first two weeks of October and will contain specific information for each affected resident.

On April 27th, 2020, Michigan Supreme Court upheld Byron Township’s medical ma*****na zoning ordinance. DeRuiter, the plaintiff in this case, sued Byron township claiming that their zoning ordinance for cultivating medical ma*****na directly conflicted with and preempted the Michigan Medical Ma*****na Act (MMMA). The supreme court held that the MMMA does not totally preempt a township’s zoning authority, as long as the township does not prohibit the cultivation of medical ma*****na.

On June 30th, 2021 the State Senate passed the 2021-22 K-12 school budget, making history with a $17.1 billion budget. This budget allows $8700 funding per student and closes the funding gap between Michigan school districts, which has been persistent for years. This budget will allot for $240 million for school nurses and counselors, $75 million in federal funds for HVAC improvements in school buildings, $6 million for career and technical education, and $4 million in additional funds for early literacy programs.

As of July 1st, 2021 the Michigan No-Fault medical fee schedule will begin to show changes that will affect seriously injured car accident victims, as well as thousands of skilled health care workers. Beginning July 1st, car accident victims who need 24/7 care will now lose 112 hours per week of No-Fault coverage, the new medical fee schedule will also impose restrictions on reimbursement rates for medical care providers. Many of Michigan’s spinal cord and TBI rehab centers are already warning going out of business as a result of these changes.
