The New Jersey Supreme Court has recertified me as an NJ Municipal Court Attorney. Only a small handful of lawyers (less than one percent) meet the rigorous academic and vetting requirements to be certified Municipal Court Lawyers.

To be certified, attorneys must:

* be a member in good standing of the New Jersey Bar for at least five years
* take a specific number of continuing legal education courses in the three years prior to filing an application
* demonstrate substantial involvement in the preparation of litigated matters
* demonstrate an unblemished reputation by submitting a list of attorneys and judges who will attest to the applicant's character and ability
* pass a written examination covering various aspects of practice in the designated specialty.

This Saturday, I along with Donna Platt, ESQ., will moderate the annual NJSBA DWI Update, Advanced DWI Practitioner CLE Seminar. This is a virtual (Zoom) seminar for the experienced/advanced practitioner, an important block of CLE for defense lawyers, prosecutors, and judges who want a deep perspective.

We always try to drill down deep on DWI issues and give our attendees a substantive and different perspective. We also try to engage in intriguing panel discussions rather than simple panelist presentations.

This year, I am excited to include an ethics block on diversity and inclusion, an often overlooked area of DWI law. We will also be drilling down on drug-impaired driving and DRE testimony post-Olenowski.

We recently received a very touching client review that recognizes my paralegal, Nellie. As many know, Nellie and I are married; we have been together since 1986. “I was pulled over back in January for driving while intoxicated. I was arrested and taken into custody where I performed a breathalyzer test with higher than average BAC results. After reading all I could about the repercussions of a DWI in the state of NJ, I made the decision that it would be best to hire a lawyer. I searched for the best DWI lawyers in the state. The first lawyer contacted me back and as I was on the phone with him I heard him texting. During our conversation I received a text from said lawyer stating all his prices and fees. This, as well as the lawyer talking himself up over the phone, left a bad taste in my mouth. There was zero sympathy and he went straight to the money subject. The next lawyer I contacted never replied back. After two days of being in panic mode and in a bad state a mind, I contacted Greggory Marootian's office where I was immediately greeted by Nellie (Greg's legal partner and wife). Nellie was very sympathetic and calmed my nerves as she could tell that I was obviously in distress. She was even able to get in contact with Greg so that I could talk to him even though he was on his way to a case. After speaking to them I immediately knew they were the right people for me. The whole process was a long and arduous journey. Throughout those 7 months, Nellie and Greg assured me that it was common practice for the whole process to take this long. Regarding my BAC results, of course I was hoping for the impossible and getting everything dismissed. But from the day one, Greg never fed me any BS. He never gave me any false hopes and told me straight up that, given my results, it would take a miracle for my case to be dismissed. He also recommended I agree to getting an expert report as it would be beneficial in my case. While I was questionable about it given that it would be an extra cost, I wanted to do whatever I could on my end to get the best results. I couldn't afford to lose my license as I work on cars for a living and needed to be able to drive to do my job. Fast forward to my final hearing, Greg was able to convince the prosecutor to dismiss all my other tickets (6 out of the 7), as well as dismiss my BAC results. The dismissal of the BAC results helped bring my penalties down to a 1st offense DUI/DWI which required me to have an interlock installed in my car for only 3 months. With my BAC being over .15, I could have lost my license with possible jail time. Greggory and Nellie Marootian are good people. They're REAL people. They talk to you as a person, not a client. They're not out for your money, they genuinely want to help you and they understand how stressful and tough this situation is. Greg and I have also developed a rapport outside of the legal aspect as he happens to be a car guy and I work on cars for a living. And Nellie is one of the sweetest people you'll ever talk to. I'm very thankful for everything they've done for me. If you're in the unfortunate situation of a DUI/DWI in the state of New Jersey, I highly recommend them.”

On October 27, 2023, at 12:00 p.m., I will be participating as a speaker in a continuing legal education (CLE) seminar with NJ Volunteer Lawyers For Justice (VLJ). This is a free CLE program for volunteer lawyers (existing volunteers or lawyers who may want to volunteer with VLJ) who represent VLJ clients with license suspensions arising from municipal court matters.

VLJ staff lawyer Erin Berman, Esq. organized the seminar. I have worked with Erin. She is a skilled lawyer and a passionate advocate for her clients. The panel includes The Honorable Jonathan H. Rosenbluth, who presides in multiple NJ Municipal Courts and always ensures fairness and protects constitutional protections to everyone who comes before him. Maplewood Municipal Prosecutor, Fordham Law School Professor, and past President of the New Jersey State Municipal Prosecutors' Association Annette DePalma, Esq., will also be on the panel. Annette is a seasoned prosecutor and an experienced and accomplished trial lawyer.

I have been working on an upcoming sentencing hearing where the Judge has broad discretion in sentencing, including a jail term. While preparing a sentencing memorandum, I found an interesting article by Eric L. Muller, a former prosecutor (Assistant U.S. Attorney) and Seton Hall Law School Professor (A.B., Brown University & J.D., Yale Law School). I cited the article in my memo, arguing for mercy for my client whose non-intentional actions were rooted in significant psychological trauma he endured.

In the 1993 article published in the Seton Hall Law Review, VIRTUE OF MERCY IN CRIMINAL SENTENCING, Eric Muller says this regarding the virtue of mercy in criminal law sentencing: “Mercy is neither a redundancy of justice nor an indefensible deviation from justice. Instead, for a judge who must sentence an offender from a range of authorized punishments, mercy is a guarantor of justice. Therefore, in a criminal justice system steeped in respect for innate human dignity, mercy is a moral virtue.” He says that “[m]ercy stands between retribution and revenge.”

Nobody wants a society of anarchy and lawlessness. However, mercy in the system is a moral virtue and a necessary component of justice. A criminal justice system rooted in retribution and revenge is archaic, immoral, inhumane, and a “deviation from justice.”

The NJ Supreme Court ruled that an MDT search showing a suspended registrant justified the stop (citing and affirming Donis), but when the officer determined that the driver did not reasonably/objectively match the MDT description of the car’s registrant, the stop became unreasonable and should have been terminated.

Today’s Supreme Court opinion examines whether police had reasonable suspicion to stop a vehicle based on the owner’s license being suspended, whether the search was prolonged after the officers learned the owner was not driving, and if the trial jury should have been permitted to see body camera footage of objection to the search.
