A year after his death, Malcolm-Jamal Warner's widow has filed suit against his mother, alleging $1.2 million in unfulfilled obligations from their premarital agreement: a life insurance policy, a Roth IRA, and annual payments the agreement required.

I see this pattern more often than people realize. The document gets signed. The follow-through doesn't happen. And the gap between the two is where family disputes begin.

"We already have a will. Does that mean our family is protected?" Not quite.

A will names a long-term guardian for your kids. It doesn't say who has legal authority with them in the first 72 hours. It names beneficiaries for your estate. It doesn't touch your retirement accounts or life insurance. It does nothing if you're incapacitated rather than gone.

And it doesn't stay current on its own.

Most people think a signed will means their family is protected. It doesn't.

A will names who gets your stuff. It doesn't stop probate, doesn't cover you if you're incapacitated, and doesn't touch your retirement accounts or life insurance.

And if you have kids, there's a gap almost nobody plans for: the first 72 hours after an emergency, before a guardian is legally recognized, when no one may have the authority to pick your kids up or keep them safe.

Here's a stat that might surprise you: only 24 percent of Americans have a will. That means if you're thinking of three people right now who haven't done their estate plan, statistically, you're probably right.

The good news is you don't need to have a big serious conversation to change that. You just need one question: 'If something happened to you tomorrow, is your family taken care of?' That question, asked by someone they trust might be what finally gets them to get moving.
